Hse panel tackles proposals for govt coop with ICC

“At behest of former president Rodrigo Duterte, Philippines on March 17, 2018 withdrew from the Rome Statute,” Albay Rep. Edcel Lagman manifested during hearing that Philippines “must cooperate with International Criminal Court (ICC).”
House of Representatives’ joint committees on human rights and justice started hearing on two pending resolutions that call on all government agencies and departments to work with ICC.
During plenary, chamber read HR 1477 on first reading and referred it to committee on justice.
This happened amid word war of House with former president Rodrigo Duterte, who tagged chamber as “rotten institution” after it removed P650 million in confidential fund of his daughter, Vice President and Education Secretary Sara Duterte-Carpio.
HR 1477 was authored by Congressmen Benny Abante and Ramon Rodrigo Gutierrez of 1-Rider party-list.
Other measure, HR 1393, was sponsored by party-list Reps. France Castro of ACT Teachers, Raoul Manuel of Kabataan and Arlene Brosas of Gabriela.
Another similar measure, HR 1482, was filed by Lagman ,manifested during hearing Philippines “must cooperate with ICC.”
Otherwise, veteran lawmaker warned Philippines “will be renegade in community of nations.”
Lagman recalled jurisdiction of ICC over “covered crimes committed in the Philippines took effect on Nov. 1, 2011 after Philippines acceded to Rome Statute.”
But pursuant to Article 127 of Rome Statute, Philippines’ withdrawal became effective only one year after its filing, or on March 17, 2019.
“Consequently, jurisdiction of ICC on covered crimes committed in the Philippines spans period from Nov. 1, 2011 to March 16, 2019,” he noted.
Lagman said on April 24, 2017, “ verified complaint” was filed against Duterte and others for “purportedly committing crimes against humanity in the wake of Duterte’s campaign against dealers and users of illegal drugs.”
“In other words, complaint was filed when ICC still had jurisdiction,” he said.
For her part, Sen. Imee Marcos opposed resolution filed in House of Representatives urging government to cooperate with ICC probe on drug war killings during previous administration.
Marcos said allowing ICC to conduct probe is tantamount to surrendering country’s sovereignty.

Iran-backed Houthi rebels seized Israeli-linked cargo vessel Galaxy Leader Sunday and held hostage its 25 crew members. Ship had been chartered by Japanese group, and was flying flag of Bahamas.
Houthi group said move was in retaliation for Israel’s war against Hamas. It warned allies of Israel their shipping in the Bab al-Mandab Strait at entrance to Red Sea is “legitimate target.”
Bab al-Mandab is one of the world’s busiest shipping lanes, carrying about fifth of global oil consumption.
Filipino mariners comprise more than 25% of 1.5 million sea-based workers worldwide, the most from any country, according to government.
Seventeen Filipino seafarers were among individuals taken hostage after Yemen’s Houthi rebels seized Israeli-linked cargo ship in Red Sea, DFA said.
Houthi rebels captured cargo vessel Galaxy Leader and held hostage its 25 international crew, including 17 Filipinos, Foreign Affairs Undersecretary Eduardo de Vega said.
De Vega said government is concerned because incident is connected to Israel’s war against Hamas.
Bahamas-flagged, British-owned Galaxy Leader is operated by a Japanese firm but has links to Israeli businessman Abraham “Rami” Ungar.
“What reached us is that no harm will be done to foreign crew members,” De Vega said, adding DFA will hold meeting with government agencies such as DMW, Overseas Workers Welfare Administration, and Maritime Industry Authority.
DMW has communicated with and assured families of seafarers of government’s support and assistance.

SC: Govt cannot be forced to probe drug war killings

GOVERNMENT cannot be compelled to investigate and prosecute extrajudicial killings in connection with Duterte administration’s war against illegal drugs, according to Supreme Court (SC).
In decision promulgated SC said writ of continuing mandamus cannot be used to compel government to conduct investigation as it is only remedy in environmental cases.
SC en banc, in decision penned by Associate Justice Maria Filomena Singh, dismissed petition for mandamus filed by several lawyers claimed respondents then Philippine National Police (PNP) chief and now Sen. Ronald dela Rosa, late Commission on Human Rights (CHR) chairman Jose Luis Martin Gascon and then Department of Justice (DOJ) secretary Vitaliano Aguirre II failed to adequately perform their duty to prevent violations of right to life and to investigate and prosecute killings.
Petitioners asked SC to direct respondents, through writ of continuing mandamus, to investigate every allegation of violation of right to life committed under government’s drug war and prosecute perpetrators.
They also asked High Court to order respondents to submit periodic reports on actual number of extrajudicial killings and their circumstances, progress of investigation of each case and criminal charges filed in courts, as well as positive measures adopted to prevent further human rights violations.
In denying petition, SC said writ of mandamus is remedy when any tribunal, corporation, board, officer or person unlawfully neglects to do duty, or unlawfully excludes from another use or enjoyment of right or office.
High Court was not established respondents neglected their duties as respective heads of PNP, DOJ and CHR in preventing and investigating violations of right to life, in relation to drug war.
Petitioners also “offered no concrete proof respondents are remiss in their duties” and their “bare allegations cannot be given credence.”
SC noted that Gascon submitted true copies of CHR’s records for each region on its investigations of extrajudicial and drug-related killings and list of trainings it conducted for police and military sectors from 2016 to 2017.
It added petitioners cannot impose on respondents “ standards and characteristics of investigation which they deem to be appropriate and sufficient through mandamus petition, as it lies only to compel performance of purely ministerial duties.”
High Court said writ of continuing mandamus is available only in environmental cases. It is issued by court in environmental case, ordering any government agency or its officer to perform act decreed by final judgment that shall remain effective until fully satisfied.
SC said respondents cannot be required to submit periodic reports to High Court as such directive violates doctrine of separation of powers.
QC prosecutor to resolve grave threat case vs Duterte if…

“If prosecutor finds probable cause to file criminal case in court and put Duterte to trial, he will issue information and file it in regional trial court of Quezon City,” Rico Domingo, one of the lead counsels of ACT-Teachers party-list Rep. France Castro said Quezon City Prosecutor’s Office will decide on criminal complaint against former president Rodrigo Duterte based on pieces of evidence presented against him, after Duterte would rather be jailed instead of filing counter-affidavit after subpoena was issued against him.
Domingo said if Duterte fails to submit his counter-affidavit during preliminary investigation slated on Dec. 4 and 11, investigating prosecutor will take into consideration evidence provided by Castro in resolving complaint of grave threats against former president.
Domingo made statement after Duterte said he would choose to be imprisoned rather than address charges filed against him by Castro.
Quezon City senior assistant city prosecutor Ulric Badiola signed subpoena ordering Duterte to appear before fiscal’s office at 2:30 p.m. on Dec. 4 and Dec. 11.
Badiola said subpoena against Duterte was in line with preliminary investigation of the case of grave threats filed by Castro against Duterte, in connection with Article 282 of the Revised Penal Code relating to Section 6 of the Cybercrime Prevention Act of 2012.
He directed Duterte to submit his counter-affidavit as well as affidavits of his witnesses and supporting documents.
Castro filed criminal complaint against Duterte, alleging grave threats issued in his television program titled “Gikan sa Masa, Para sa Masa” on SMNI and aired on Oct. 11, where former president said, “pero ang una mong target d’yan sa intelligence fund mo, kayo, ikaw France, kayong mga komunista ang gusto kong patayin…sabihin mo na sa kanya.”
According to Castro, it was clear Duterte was referring to her, as during first part of interview, former chief executive mentioned her full name.
Castro said attacks of Duterte against her came after she scrutinized confidential funds of his daughter, Vice President and Education Secretary Sara Duterte-Carpio.
Elder Duterte could face maximum of six years imprisonment, and fine of P100,000, in case court finds him guilty of grave threats.
Duterte should be statesman enough to steer clear from matters that only tend to polarize government, like insinuating about purported plots by state security forces to topple administration of President Ferdinand Marcos Jr..
House Majority Leader Manuel Jose Dalipe pointed out Armed Forces of the Philippines (AFP) and Philippine National Police (PNP) are professionals, and the last thing they need and want are political intrigues.
“I respectfully appeal to former president Duterte to recognize paramount importance of keeping our AFP and PNP free from partisan politics…these institutions serve as bedrock of our nation’s security, and their effectiveness relies on unity and impartiality,” he said.
Zamboanga City congressman noted speculations about unrest among law enforcement authorities could “unnecessarily raise questions about professionalism and neutrality of uniformed service.”
“We have already achieved so much in our quest to professionalize our military and police service…let us not squander what we have accomplished by putting AFP and the PNP in a bad light because of these baseless statements,” Dalipe added.
At the same time administration stalwart rectified misimpressions by Duterte about an alleged “ambition” of Speaker Martin Romualdez to run for president in the May 2028 elections, where he may be pitted against his daughter.
“It’s not only baseless, but also premature,” he set record straight, adding presidential election is still too far away, and Romualdez is wasting no time ensuring swift passage of Marcos administration’s priority measures.
According to Dalipe, Duterte’s statements insinuating AFP and PNP are involved in political activities are very unfair to officers and enlisted personnel who have worked hard to restore credibility and high level of professionalism of the uniformed service.
He emphasized that as former president, Duterte should prioritize nation’s well-being over political interests, fostering environment where AFP and PNP can fulfill their duties without being entangled in divisive political agendas.
Mindanao congressman stressed that days of military adventurism are over, and AFP and PNP are focused on carrying out their constitutional mandate as pillars of the country’s democracy and sovereignty.
“AFP and PNP have more important things to do than watching Congress, as claimed by former president…our uniformed service must be insulated from partisan activities and should maintain highest degree of professionalism,” Dalipe said.
He emphasized that any form of partisanship in AFP and PNP could undermine their professionalism and erode public trust.

“Supported by rules-based international order and our growing partnerships, both time-tested and new ones, we will insist on preservation of the sovereignty and integrity of the country, while working closely with international partners in bilateral, regional and multilateral settings in developing rules and processes to address these challenges,” President Ferdinand Marcos Jr. said Chinese military facilities on reclaimed land features in West Philippine Sea have come alarmingly close to country’s coastlines.
FMJ expressed concern over what he called “false narratives,” “coercive tactics” and “dangerous maneuvers” aimed at restricting activities in Philippine territorial waters.
In his remarks at Asia-Pacific Center for Security Studies, Marcos said Philippines has to work with its allies, including treaty partner United States, to maintain peace in South China Sea and West Philippine Sea. Philippines calls its area in South China Sea the West Philippine Sea.
FMJ did not specifically mention China, but he was apparently referring to Asian giant, had reclaimed numerous land features in West Philippine Sea and turned them into bases and fortresses Chinese aircraft and ships are deployed to harass Philippine vessels and fishing boats.
He said tensions in West Philippine Sea are growing, with “persistent unlawful threats and challenges” against Philippines’ sovereign rights and jurisdiction over its exclusive economic zone (EEZ) and continental shelf.
Such actions, he said, were violations of international law, specifically 1982 UN Convention on the Law of the Sea (UNCLOS), and were inconsistent with 2002 Declaration on Conduct of Parties in the South China Sea.
FMJ lamented progress has been slow in crafting of code of conduct for South China Sea claimants.
He revealed Philippines has approached other countries in the region with which it has disputes like Vietnam and Malaysia “to make our own code of conduct.”
FMJ described role of the Philippines’ alliance with US as “critical,” noting that Washington is Manila’s most traditional ally and sole treaty partner.
“Increasing tensions in South China Sea require we partner with our allies and our friends around the world so as to come to some kind of resolution and to maintain peace,” he said.
FMJ said Philippines appreciates “concrete manifestations” of US of its continued support as well as growing number of foreign partners backing Philippines’ position.
“So, I have said it before and I will say it again, Philippines will not give single square inch of our territory to any foreign power. Law is clear as defined by UNCLOS and final and binding 2016 Award on South China Sea Arbitration,” he added.
FMJ was referring to ruling of an arbitral court based in The Hague, voided China’s expansive maritime claim in resource-rich South China Sea and affirmed Philippines’ sovereign rights over its EEZ.
China vowed not to recognize landmark ruling, calling it mere piece of paper.
FMJ detailed unlawful activities in West Philippine Sea endanger lives and harm environment.
He said Philippines’ regular routine and resupply missions in Ayungin Shoal are subjected to “coercive tactics and dangerous maneuvers” by Chinese coast guard and maritime militia vessels.
FMJ also cited “rampant illegal, unreported and unregulated” fishing and militarization of reclaimed features in South China Sea.
He said recent Philippine inspection of Escoda (Sabina) and Romulo (Iroquois) Reefs revealed “direct correlation between presence of maritime militia vessels and reef damage in those features.”
“If only for that, impact on biodiversity and environment are… I’m afraid assessed as possibly already irreversible… imperils livelihoods… imperils future generations of Filipinos, strong, factual messaging in support of our lawful exercise of our rights under international law, and will call out recent incidents in our EEZ, it demonstrates strength of our alliance and partnership and challenges attempts to perpetuate false narratives,” FMJ said.
FMJ argued rhetoric is not enough to ensure security in West Philippine Sea.
“We need to upgrade our defense and civilian law enforcement capabilities not only to defend ourselves but also to enable us to become reliable partner in promoting and guaranteeing regional security… would require greater substantial infusions into funding streams needed for our armed forces and coast guard modernization plans, including lines of effort to enhance cyber cooperation, I am optimistic from our recent engagements with our American counterparts, including US legislators, and certainly in executive department, to elevate our partnership and dedicate resources to match our commitments,” Chief Executive said.
FMJ said Philippines and US have been working on bilateral planning and tracking mechanism that is seen to accelerate concrete and substantial capability development investments and activities to meet shared defense and security objectives over next five years.
Defense chiefs of the two countries also met in Jakarta on sidelines of Association of Southeast Asian Nations Defense Ministers Meeting Plus, to discuss efforts to further strengthen their alliance, he added.
“Our growing network of partners, including Australia, Japan, the Republic of Korea, the UK, European Union will serve as force multipliers which will help us bring our country closer to vision of peaceful, secure and prosperous nation, within secure and prosperous region, so, I hope to continue this dialogue with all of you as we make our way on this principled path that we have chosen,” FMJ said.
FMJ delivered his strongly worded statements days after his meeting in San Francisco with Chinese President Xi Jinping, with whom he discussed ways to lessen tensions in West Philippine Sea.
Before delivering his remarks, FMJ visited headquarters of US Indo Pacific Command, first Philippine president to do so, according to Malacañang.
He also visited USS Arizona Memorial at Pearl Harbor, where he offered wreath to honor those who died during the attack by Japanese forces on Dec. 7, 1941.
In interview at same forum, FMJ described conflict in Myanmar as “very, very difficult problem” of Association of Southeast Asian Nations (ASEAN).
“There is great deal of impetus for ASEAN to solve this problem…but it is very, very difficult problem,” FMJ said.
According to FMJ, Philippines is interested in developments in Myanmar because Filipinos were among those being trafficked to conflict-torn country.
More than two million people have been displaced by clashes between ethnic armed groups and Myanmar military, according to United Nations.
ASEAN members had criticized Myanmar’s junta for failing to achieve significant gains on plan supposed to address crisis stemmed from military coup unseated elected civilian government.
Junta has been prohibited from participating in ASEAN summits since 2022. Myanmar has been replaced by Philippines as event’s host for 2026.
During ASEAN Retreat in Jakarta last September, FMJ said one test of regional bloc’s relevance is its ability to facilitate peaceful resolution to Myanmar problem.
He stressed ASEAN’s significance in international stage can only be maintained so long as it can show rest of the world that it continues to be “ force for positive change.”
“We remain firm resolution to Myanmar crisis should be Myanmar-owned and Myanmar-led…we continue to support efforts of ASEAN Chair to engage all stakeholders in Myanmar, we reiterate all efforts in Myanmar should be in line with five-point consensus and done in coordination with Chair of ASEAN,”FMJ c oncluded.

“We hope that our plight was really discussed and there will be good changes in what we experience in Scarborough Shoal…we are scheduled to return to Bajo de Masinloc ; we will be able to determine if there are indeed changes in Scarborough Shoal, if indeed, Marcos and Xi’s meeting was smooth,” Tropical Fish Gatherer Association (San Salvador, Masinloc, Zambales) president Joeffrey Elad said Filipino fisherfolk will sail again to Panatag (Scarborough) Shoal to determine if supposed meeting between President Ferdinand Marcos Jr. and Chinese President Xi Jinping in San Francisco, California will result in improved situation in the area amid harassment of Chinese coast guard and militia.
Elad hope talks between two leaders will benefit fishermen currently experiencing bullying from Chinese ships.
During their meeting, FMJ told Xi Filipino fishermen should have access to fishing grounds in South China Sea, where they again reaffirmed commitment to dialogue, but admitted challenges remain.
Elad said one of the two fishing boats that returned from Panatag Shoal went home with few fish caught amid harassment from Chinese.
“Last Nov. 13, we arrived from Scarborough… mother boat had caught lot of fish, but other boat managed to bring home very limited catch as fishermen were tailed by patrol boat from China…they were not able to fish properly,” he added.
Elad noted that fishing boat spends at least P150,000 in fuel, ice, food, salaries of captain and crew during seven-day sail, but suffers losses because of harassment from Chinese boats.
“We spend at least P60,000 for diesel, P20,000 for ice…we also spend for food and pay for salaries of boat captain and crew, or at least P150,000… other boat was able to sell only P59,000 worth of fish compared to expenses which we only sourced through loans,” he said.
