4 suffered ‘walking pneumonia’

“Based on five-year data, ILI cases are expected to continue declining in the coming weeks but are expected to rise again by start of January,” Department of Health (DOH) disclosed four confirmed cases of “walking pneumonia” or Mycoplasma pneumoniae have been recorded by DOH in the country.
Confirmed cases of walking pneumonia were detected among reported influenza-like illness (ILI) cases, according to DOH.
DOH however, stressed Mycoplasma pneumoniae is not novel or new pathogen and has been previously detected in local cases.
Rise in cases of ILI nationwide, DOH said, has already slowed down with total of 9,834 recorded from Oct. 29 to Nov. 11,2023. Figure is 11 percent lower than ILI cases two weeks prior.
Meanwhile, President Ferdinand Marcos Jr. is “doing well” after contracting COVID-19 for third time, according to Presidential Communications Office Secretary Cheloy Garafil.
FMJ, 66, tested positive for disease on Monday night. He was advised by his doctors to undergo mandatory five-day isolation.
FMJ is currently staying at Bahay Pangulo within Palace complex.
In statement, PCO said “the President remains fit to carry out his duties and will be continuing his scheduled meetings via teleconference.”
FMJ tested positive for COVID-19 in July 2022 and in March 2020…he received his second COVID-19 booster dose in August 2022.
According to DOH, Philippines logged total of 1,340 new coronavirus cases from Nov. 28 to Dec. 4, highest number of fresh infections in 19 weeks.
Despite slight increase in national level, country’s health system remains low risk, DOH said.
It said respiratory diseases such as influenza and COVID-19 are expected to increase during colder months.

TVJ sings ‘Eat Bulaga’, once more with feelings

“It is Joey who coined and created these marks in 1979 in my kitchen, in White Plains…in our petition, we explained significance of design and origin of each word comprises Eat Bulaga,” former Senate President and television host comedian Tito Sotto said in statement before press briefing at TV5’s Studio 4 in Mandaluyong city for first time since moving to TV5, Eat Bulaga original hosts Tito Sotto, Vic Sotto and Joey de Leon (TVJ), along with “legit dabarkads,” opened their noontime show E.A.T. singing Eat Bulaga theme song without having to mute word “Bulaga.”
Intellectual Property Office of the Philippines had ruled in TVJ’s favor over their trademark dispute with TAPE Inc., canceling latter’s trademark registration of Eat Bulaga and EB.
TAPE Inc. is blocktime producer of 44-year-old noontime show Eat Bulaga, with new set of hosts, on GMA 7.
While he acknowledged favorable decision is “just beginning,” it is “indeed milestone and welcoming development to our legal claims.”
Asked by media as to when they will officially use Eat Bulaga for the program itself, Tito said, “Perhaps after presscon or after the day, we will discuss other legal matters on our own…everyone knows, even people we interview in segment Sugod Bahay, they thank EAT, Eat Bulaga. ..they know, people know… Eat Bulaga is TVJ, TVJ is Eat Bulaga.”
For his part, Vic said, “perhaps when others stop using it and show respect, that might be right time.”
But according to TVJ’s legal counsel Enrique dela Cruz of Divina Law, TVJ is free to use Eat Bulaga not just in the theme song but as program title “anytime.”
He said, “they can use it even before decision came out because their registration is not entertainment… registration is for merchandise, like Tito Sen maintained.”
“Now it is government who said rightful owner of title Eat Bulaga is TVJ, so they should respect it so that only one will use it,” he added.
TAPE’s legal counsel Maggi Abraham-Garduque earlier said blocktime producer will “avail of all legal actions,remedies to reverse this decision.”
Tito said they welcome moves to appeal, saying, “we know and we feel we’re standing on right side of fence, so anybody has right to appeal, oK lang…it is not problem.
Dela Cruz said that within 10 days, they expect TAPE to appeal to director of Bureau of Legal Affairs, who will “decide on the matter within 30 days.”
But Dela Cruz urged TAPE to respect decision, emphasizing that government has spoken, and TVJ is rightful owner of Eat Bulaga title.
He pointed out that TAPE’s only basis for using the title, their trademark registration, is now canceled.
“Their only basis for using Eat Bulaga is that they have trademark registration… government said already cancelled, that they were not the creators…they have no basis anymore, why would they still use it,” Dela Cruz said.
Nevertheless, this latest development is considered by TVJ as early Christmas gift.
“Definitely, it’s Christmas gift…we’re so happy about it, being officially recognized by government, not just by the people, by law,” Tito said in response to media question.
TVJ as well as other hosts of Eat Bulaga severed ties with TAPE and left GMA 7 after 28 years last May 31, resulting in bitter feud over trademark ownership.
Asked if there’s room for “forgiveness” and reconciliation this season, Joey said, “Actually, we still love them after 44 years of being together…it is them who do not love us…we have no hard feelings for them…but they should respect us,” before adding in his signature humor, “Pagbigyan naman nila kami kasi ugod-ugod na kami.”

“Yet decline of performance in all three fields measured can only be partially attributed to COVID-19 pandemic… scores in reading, science and math have already been falling prior to 2018,” Organization for Economic Cooperation and Development (OECD) secretary-general Mathias Cormann for second straight assessment, Philippines landed in bottom 10 out of 81 countries in reading comprehension, mathematics and science and showed minimal improvement, results of 2022 Program for International Student Assessment (PISA) test revealed.
After being ranked lowest out of 79 participating countries in 2018 in reading comprehension, Philippines was ranked 76th out of 81 countries for 2022.
Indicators of test, showed despite moving up rank, performance of top-performing students (TPS) in the country did not go up in percentage points, while low-performing students (LPS) registered 4.3 percent decline in reading comprehension proficiency levels.
Philippines placed third-lowest in science after being ranked second-lowest previously, with TPS proficiency moving up by 0.1 percent since 2018 and LPS dropping by 0.7 percent.
In mathematics, country ranked sixth lowest after being second-lowest in 2018, with indicators stating no percentage hike among TPS and improvement of 3.3 percentage points for LPS.
Overall, Philippines achieved 2.2 percentage point hike in mathematics from 2018 to 2022, 6.9 percent in reading comprehension and 0.8-percent drop in science proficiency.
PISA, developed by OECD, measures 15-year-olds’ ability to use their reading, mathematics and science knowledge skills to meet real-life challenges.
This year’s PISA is first large-scale study on how COVID-19 pandemic affected students, Cormann said at press conference.
Department of Education will hold PISA national forum at its central office, where its officials are expected to address dismal performance of Philippines last year.
Vice President and Education Secretary Sara Duterte-Carpio has implemented sweeping reforms to improve students’ performance in mathematics, science and reading comprehension despite calls from education sector stakeholders to implement policies where experts have been consulted.
This includes “Catch-up Fridays” in all public schools, starting next year, students will spend Fridays mastering reading comprehension and critical thinking, reducing traditional learning delivery for students by one day.
Hse supermajority backs FMJ on peace talks

“As united voice of House of Representatives, representing all political parties, we collectively express our unwavering support for President Ferdinand Marcos Jr.’s initiative for peace and national unity,” joint statement read, allies of President Marcos comprising so-called supermajority in House of Representatives have rallied behind his initiative to end decades-long communist insurgency through fresh peace negotiations.
In joint manifesto, leaders of power blocs said they have formed “united front” to support Marcos’ “all-encompassing peace initiative.”
Manifesto was issued as Vice President Sara Duterte-Carpio appealed to FMJ to “reconsider” resumption of peace talks, describing it as “agreement with devil.”
Coalition represents 280 members of 311-strong chamber led by Speaker Ferdinand Martin Romualdez.
House Secretary General Reginald Velasco released manifesto recently.
Party stalwarts said Marcos’ pursuit of peace is “ historic move” marks “pivotal moment in our nation’s journey towards lasting peace and sustainable development.”
“President Marcos’ call for peace transcends political boundaries and speaks to core of our shared values as Filipinos… call for understanding, cooperation and collective action towards future where every citizen can live in harmony and prosperity,” House leaders said.
Among power blocs backing Marcos’ peace initiative were ruling Lakas-CMD led by Romualdez, Nationalist People’s Coalition of late tycoon Danding Cojuangco and PDP-Laban party of former president Rodrigo Duterte, Nacionalista Party led by former Senate president Manny Villar, National Unity Party, Party-list Coalition Foundation Inc., Partido Navoteño, among others.
Romualdez earlier led in filing of House Concurrent Resolutions 19, 20, 21 and 22 supporting amnesty proclamations of President Marcos. House committees on justice and on national defense approved resolutions. Amnesty Proclamations 403, 404, 405 and 406 cover members of communist groups and Moro separatists.
“Timely adoption of these concurrent resolutions is attuned with spirit of hope, peace and joy Christmas season brings,” Romualdez said.
“Grant of amnesty to former combatants or rebels who may have committed unlawful acts in furtherance of their respective political beliefs and who wish to return to folds of law, will create climate conducive for peace and reconciliation, pave way for them to reintegrate into society and provide them access to government’s socio-economic services,” resolutions read.
“There is need for government to act on rebel and insurgent returnees’ request for grant of amnesty so that they may live in peace in pursuit of productive endeavors without prejudice to any legal arrangement that may result from negotiated settlement government is pursuing with various rebel and insurgent groups,” they added.
Assistant Minority Leader Arlene Brosas of women’s group Gabriela, flagged House Concurrent Resolution 20 granting amnesty to “former members of CPP-NPA-NDF or their front organizations.”
Brosas said by conflating those unarmed and armed individuals charged with various offenses, amnesty proclamations appear to have restored repealed RA 1700 ,Anti-Subversion Act, penalizes membership in organizations deemed subversive.
“Proclamations do not distinguish those who took up arms from unarmed citizens…there is also mention of front organizations always being used to tag people’s organizations, NGOs, civil society organizations as communists and harass them and endanger lives of activists,” she said.
“In this case, this could result in increase in human rights violations,” Brosas added.
For voicing her opposition to Marcos’ initiative to talk peace with rebels, Vice President Duterte should resign as Department of Education (DepEd) secretary, according to former senator Leila de Lima.
In her post on X, De Lima said no one was preventing Duterte from criticizing present administration but she should remember that she is still member of Cabinet.
“Peace talks is not within core competence of her portfolio as DepEd Sec…she should resign as DepEd Sec if she keeps on publicly opposing FMJ’s Cabinet policy decision have nothing to do with DepEd,” she said.
“She cannot eat cake and keep it too…she can only go on criticizing FMJ’s policies if she is no longer member of Cabinet and speaks only as VP,” she stressed.
Duterte released video statement opposing new peace efforts, as she appealed to FMJ review his policies and called Oslo communique “agreement with devil.”
Sen. Ronald Dela Rosa, on other hand, held press briefing to express his support for Duterte, saying communists cannot be trusted. Dela Rosa was national police chief under Duterte administration.
“They are not sincere when it comes to peace talks,” Dela Rosa said, citing setbacks suffered by communist movement since death of Communist Party of the Philippines founder Jose Maria Sison.
“You are leaderless… to make demands,” Dela Rosa said, addressing communist movement.
Asked if disagreement between Duterte and FMJ on peace talks indicated cracks in their alliance, Dela Rosa said it was only normal for Vice President to oppose peace talks because of her first-hand experience in dealing with communist insurgency when she was mayor in Davao.
“I am in favor of peace talks provided there is no ceasefire, which they will only use to strengthen their forces,” Dela Rosa said.
Armed Forces of the Philippines (AFP) chief Gen. Romeo Brawner Jr. has admitted some soldiers agree with Duterte’s apprehensions over Marcos administration’s possible peace negotiations with communists.
“First of all, I cannot blame the Vice President for saying this… this opinion is shared by so many in our country, even soldiers,” he told media.
He said rebels took advantage of previous peace negotiations to consolidate and strengthen their position.
“But right now, we believe statement is really moving towards lasting peace… I believe this could lead to lasting peace,” he said, referring to joint statement of Marcos administration and National Democratic Front signed last month in Oslo, Norway.
“First of all, they said there will be no pre-conditions, there will be no ceasefire, there will be no release of political prisoners, so only exploratory talks,” Brawner said. “So I told our troops, our operations continue…don’t be alarmed by this exploratory talks.”
He also said Sison’s death was big blow to rebel group.
Brawner allayed fears differences in opinion among ranks may cause discord.
Meanwhile, militant fishers’ group Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya) said Duterte has proven herself to be real enemy of the country for trying to sabotage government’s peace talks with rebels.
“Now it can be said that VP Duterte is the one who’s against peace, thus enemy of the nation,” Pamalakaya vice chairman Ronnel Arambulo said in statement.
Bagong Alyansang Makabayan president Renato Reyes said government should be commended for supporting peace negotiations.
“Talking peace is always better than relying on militarist approach to end armed struggle,” he said.

TVJ wins ‘Eat Bulaga’ trademark case

“Respondent-Registrant TAPE Inc.’s existing trademark registrations over marks ‘Eat Bulaga and EB’ and ‘EB’ should be cancelled as they were obtained in contravention of provisions of Republic Act, RA No. 8293 or Intellectual Property Code of the Philippines ,IP Code,” Intellectual Property Office of the Philippines (IPOPHL) has canceled Television and Production Exponents Inc. (TAPE Inc.)’s trademark registration of “Eat Bulaga.”
TAPE Inc. failed to provide context on how they came up with term “Eat Bulaga” as title for noontime show back in 1979, according to IPOPHIL.
Tito Sotto, Vic Sotto and Joey de Leon managed to attest their ownership claim over Eat Bulaga trademark.
“Having sufficiently established how Petitioners coined EAT BULAGA mark, it is Petitioners and not Respondent-Registrant who own mark, considering Petitioners are owners, they have absolute and exclusive right to register EAT BULAGA mark and all variations thereto, including subject ‘Eat Bulaga’ mark and ‘EB’ mark, under its name,” IPOPHL said.
Reacting to news, Tito Sotto wrote in Facebook post: “Praise God…salamat sa sagot sa aming panalangin.”
In statement sent to media, TAPE’s legal counsel Maggi Abraham-Garduque stressed production company “will avail of all legal actions or remedies to reverse this decision.”
While TAPE Inc.’s handling lawyer for IPOPHL cases has yet to receive copy of the said decision, Garduque relayed company could appeal decision to director of Bureau of Legal Authorities of IPOPHL.
“If still unsatisfied with decision of the director, they can still appeal it to director general of IPO,” Garduque said.
IPOPHL granted “Eat Bulaga” trademark renewal to TAPE last June 14, 2023 and effective until June 14, 2033.
Decision also said TAPE did not “refuse nor contradict” explanation of petitioners on how they came up with “Eat Bulaga” name and had also helped “corroborate” their story.
Alon wrote in her decision:
“In fact, Respondent-Registrant even corroborated Petitioners’ explanation by averring ‘After their engagement, we thought of name for noontime show, I submitted several names to Romy including “Eat Bulaga” which was suggested by Joey. Romy chose name “Eat Bulaga” amongst name in the list.”
“Romy” refers to Romeo Jalosjos Sr., owner of TAPE, Inc.
TVJ on June 2 filed petition to cancel TAPE’s trademark of “Eat Bulaga” on grounds their former company obtained this “fraudulently.”
On May 31, noontime show trio TVJ left TAPE Inc., which produced “Eat Bulaga” for GMA-7 on blocktime agreement.
TVJ camp then moved to TV5 and hosted show by name of “E.A.T.”
