Fireworks industry cried proposed nationwide ban on firecrackers

“Whenever there’s ban, all legal manufacturers will close and follow ban, but real culprit in all these accidents and injuries are illegal ones,” Philippine Fireworks Association president Jovenson Ong said legitimate fireworks industry stakeholders are appealing to Interior and Local Government Secretary Benhur Abalos not to implement proposed nationwide ban on firecrackers.
Appeals were made after Abalos proposed to local government units (LGUs) to impose ban.
Ong told media in text message t they are humbly requesting Department of the Interior and Local Government chief “not to impose ban.”
He added once ban is implemented, illegal fireworks stakeholders would not close shop and actually earn a lot more after legitimate ones comply with ban.
“Let’s not reward illegal manufacturers by having ban…instead, government should put more effort in regulating existing laws…to clamp down on these illegal manufacturers who either don’t have licenses or PS MARKs on their products, we should stop them once and for all from getting their hands on regulated chemicals,” Ong said in appealing to Abalos.
PS MARKs refer to Philippine Standard Quality and/or Safety Mark and Import Commodity Clearance sticker.
Ong suggested “DTI-BPS should close all non-PS MARKed manufacturers who year in and year out don’t want to apply for PS MARK licenses.”
He also noted smuggled fireworks from China and online sale of illegal fireworks and regulated chemicals all compete with legally manufactured fireworks that they have been regularly complaining against yet these still continue to operate.
Philippine Pyrotechnics Manufacturers and Dealers Association Inc. president Lea Alapide explained Republic Act 7183 or law regulating sale, manufacture, distribution and use of firecrackers and other pyrotechnic devices was created in 1992 and 31 years later, its provisions are still not yet properly implemented.

“We will give proper statement at the proper time…we have yet to receive notice officially,” Sonshine Media Network International (SMNI) legal counsel Mark Tolentino gave assurance media network will issue official statement once copy of National Telecommunications Commission (NTC) decision is finally received.
NTC has suspended radio and TV channels of SMNI for allegedly breaking terms and conditions of its legislative franchise.
In show-cause order, NTC told Swara Sug Media Corp., parent company of SMNI, to submit in writing within 15 days its defense.
For meantime, NTC suspended radio and TV stations of SMNI for 30 days to make way for investigation that will commence on Jan. 4, 2024.
NTC decided to force SMNI off air in compliance with Resolution 189 approved by House of Representatives. Resolution calls on NTC to suspend business of Swara Sug for allegedly violating terms and conditions of its franchise, Republic Act 11422.
Resolution lists multiple violations reportedly committed by SMNI in its media business. Issue stemmed from allegations made by SMNI hosts Lorraine Badoy and Jeffrey Celiz that Speaker Martin Romualdez spent P1.8 billion on foreign travel between January and October 2023.
In House committee hearing, Secretary General Reginald Velasco disputed SMNI’s claim, and showed records Romualdez spent way below that amount, at P4.35 million.
Celiz admitted he failed to validate figures that were given to him by undisclosed source. He was ordered detained at House for his refusal to identify source.
Badoy was also ordered detained for showing “disrespect” to House. She and Celiz staged hunger strike while in detention.
House reprimanded SMNI for several occasions that it tagged media and opposition figures as members of communist movement without presenting any proof.
On business side of franchise, House noted SMNI has failed to offer to public at least 30 percent of its outstanding stock. Similarly, it flagged changes in SMNI’s corporate structure done without congressional approval.
For NTC, these reasons hold enough water to require SMNI to go off air, as agency sets out to conduct its own hearing on issue next year.
SMNI, operated by Swara Sug, serves as broadcasting arm of Kingdom of Jesus Christ religious leader Apollo Quiboloy, who claims to be appointed son of God.
Quiboloy is on most wanted list of US Federal Bureau of Investigation for multiple offenses including sex trafficking of children.
SMNI on Thursday said it has yet to receive copy of suspension order.
In message to media, Tolentino gave assurance SMNI will issue official statement once copy of NTC decision is finally received.
Prior to 30-day suspension by NTC, Movie and Television Review and Classification Board (MTRCB) imposed 14-day preventive suspension order on two programs of SMNI feature former president Rodrigo Duterte and Badoy.
Tolentino has said appeal on MTRCB ruling will be filed before Christmas.
Sen. Imee Marcos slammed NTC for simultaneously imposing show cause order and 30-day suspension of operations of SMNI due to alleged franchise violations.
“Who’s afraid of SMNI.. media entities will remain to uphold freedom of the press, speech, and thought, why must we shut down all those who do not agree with us, not even allowing chance to explain first…how could NTC issue show-cause order but simultaneously hand down 30-day suspension…amazing,are we afraid SMNI may be right…are we afraid of the truth,”” Marcos said as she accused NTC of silencing Quiboloy network.
Sen. Risa Hontiveros is set to lead inquiry on Quiboloy based on his former followers’ allegations that they were forced to solicit money for his lavish lifestyle and to provide sexual services to the pastor.
Although it believes network and its talents must be held accountable for peddling disinformation and hate speech, National Union of Journalists in the Philippines (NUJP) said suspension order issued against SMNI is reminiscent of previous administration’s attempts to weaponize law against media.
“Media workers have right to feel vindicated or even celebrate these developments, but we cannot lose sight of how these moves have been used against ABS-CBN, Bulatlat and PinoyWeekly,” NUJP said in statement.
It said network, its talents and consultants should be held accountable for its offenses, particularly for spreading disinformation and hate speech, “and not for simply offending member of Congress.”
“Even as SMNI and its supporters cry press freedom and freedom of expression now, may they also reflect on how they cheered on and abetted similar moves when these tactics were being used against journalists and newsrooms,” it added.
Earlier, NUJP maintained freedoms of expression and press are not blanket justifications for hate speech, vilification and threats.

Police have also tracked down three civilians who posted copy of video on Facebook. They face criminal charges for violating Republic Act 10175 or Cybercrime Prevention Act and RA 10173, data privacy law.
Col. Jean Fajardo, PNP public information officer, urged netizens to refrain from sharing video on their social media accounts.
“It was not intended to be shared. Let us respect the privacy of the victim and his family,” she said.
Quezon City Mayor Ma. Josefina “Joy” Belmonte-Alimurung condemned the leak of video.
Describing it as breach of privacy and basic human decency, Belmonte directed Maranan to conduct investigation against all police personnel involved at scene with corresponding sanctions to those at fault.
“Police procedures, including evidence collection, should be meticulously recorded without violating principles of trust, professionalism and confidentiality that our law enforcers should uphold,” she said.
Valdez, 76, died at his home in Quezon City on Dec. 17. Cause of his death has yet to be released, with QCPD vowing to conduct thorough investigation.
Belmonte urged Filipinos to refrain from sharing leaked video. She also expressed her condolences to the family and friends of the late actor.
“Let us respect privacy and dignity of the late actor and his family in this time of intense grief… highly distasteful for anyone to use sad and unfortunate demise of individual to gain social media mileage and popularity,” she concluded.
“That is actually subsequent punishment and that already exceeds power of MTRCB..it is not board of censor… only classification board and of course, suspension order was done because host asked question…you can issue preventive suspension if you ask question,” Former presidential spokesman Harry Roque backed decision of SMNI to file appeal.
Sonshine Media Network International (SMNI) is expected to file motion for reconsideration after Movie and Television Review and Classification Board (MTRCB) imposed 14-day preventive suspension order on two of its programs feature former president Rodrigo Duterte and former administration official Lorraine Badoy.
SMNI legal officer Mark Tolentino said appeal would be filed “before Christmas.”
“They can appeal it… I hope they appeal it because what is at stake here is freedom of expression and freedom of press,” Roque told media.
MTRCB issued 14-day suspension order on “Gikan sa Masa, Para sa Masa” and “Laban Kasama ang Bayan” effective last Monday.
MTRCB said suspension was result of “thorough review and investigation” on supposed violations on show’s aired content.
“If host asks question about issue concerning public interest and as far as former president is concerned, that is president’s style, we are used to it…when he was president, he was never censored using same language,” Roque noted.
MTRCB maintained it was found certain aspects of above-mentioned programs may have violated established guidelines and standards set by Presidential Decree 1986 and its implementing rules and regulations governing broadcasting content.
It added it received multiple complaints regarding alleged death threat made on show “Gikan sa Masa,” but did not directly name Duterte as guest.
SMNI had committed to pre-recording and reviewing episodes, but another complaint on alleged death threats and profane language was filed regarding another episode last month.
“Laban Kasama ang Bayan,” for its part, was suspended over unverified report claiming that Speaker Martin Romualdez has travel funds amounting to P1.8 billion.
Badoy and co-anchor Jeffrey Celiz were recently detained at House of Representatives after they were cited in contempt over unverified report.
Meanwhile, Sen. Francis Tolentino reacted to MTRCB’s decision to suspend two programs of SMNI.
He said he has yet to read decision and could not yet comment on whether it was legally sound.
“If MTRCB will stick to facts and evidence, they may be correct. If you transgress freedom of press and freedom of expression, these are solid constitutional grounds that implicate higher rights,” he said during Kapihan sa Manila Bay forum.
“Freedom of the press occupies higher rank in hierarchy of rights anywhere in the world,” Tolentino said.
Earlier, Tolentino had called for banning of movie “Barbie” for violating Filipino fisherfolks’ rights in West Philippine Sea with map showing China’s invalidated nine-dash line in one of the scenes.
“Rights of our fishermen, that’s not movie,” he said.

Senate Deputy Majority Leader JV Ejercito, meanwhile, reiterated his suspicions China could be funding destabilization plot against Marcos administration to divert attention from its bullying in WPS.
“Most of these people are influencers identified with former administration…they are being used for destabilization efforts,” said Ejercito, who noted he has been targeted by trolls for his stance on WPS issue.
Ejercito clarified he does not believe former president Rodrigo Duterte is behind any destabilization effort. “There is perception that former president Duterte is pro-China but I don’t think he is behind it… I’m hoping that they would realize they are being used for destabilization efforts… not going to do our country good…any destabilization, any adventurism, at this point, will not be good because it will only cause political instability and economic instability…we can’t really progress anymore, would take while before country would be able to rebound…that’s why I will not welcome any adventurism at this time, ” he said.
He said other officials targeted by trolls were Speaker Martin Romualdez, Senate President Juan Miguel Zubiri, Defense Secretary Gilbert Teodoro and Philippine Coast Guard spokesman Commander Jay Tarriela, who openly criticized China’s bullying and aggression in the West Philippine Sea.
He said trolls were obviously behind spread of misleading information as messages were “copy-paste” or rehashed. “What I can’t stomach is Filipinos will side with bully and aggressor like China.”
Ejercito also respects Marcos’ decision not to call for replacement of Huang.
President Ferdinand Marcos Jr. emphasized need for “paradigm shift” in tackling China’s increasingly aggressive behavior in WPS as diplomatic efforts with Beijing were heading in “poor direction.”
In interview with Japanese media, FMJ said “traditional methods of diplomacy”such as sending note verbales and summoning Chinese envoys had been disregarded by Beijing.
“We have been doing this for many years now, with very little progress, we have to do something that we have not done before…we have to come up with new concept, new principle,new idea so that we move needle other way…it’s going up, let’s move needle back…so paradigm shift is something that we have to formulate,” FMJ was quoted as saying in release issued by Presidential Communications Office.
Relations between Philippines and China have deteriorated under Marcos, who has sought to strengthen ties with United States and push back against Beijing’s aggressions in WPS.
In contrast, his predecessor Rodrigo Duterte pursued foreign policy shift toward China in exchange for investment pledges.
Earlier this month, government accused China Coast Guard of ramming and firing water cannons at Philippine supply boats.
China claims almost entire South China Sea, encompassing waters and islands close to its neighbors’ shores. It has ignored international tribunal ruling in 2016, stated claims have no legal basis.
FMJ also said Philippines will continue talking to its partners not only in Indo-Pacific region but also globally if necessary, to de-escalate tension in vital waterway.
“We do not want to go to the point where there are incidents that might cause actual violent conflict, and so, we have, in my review, it’s time countries that feel that they have involvement in this situation, we have to come up with paradigm shift , ” chief executive said.
