Ch shoots flares at BFAR plane

“On Aug. 22, two Philippine military aircraft trespassed into airspace near Nansha Islands, including Zhubi Jiao (Subi Reef), where China is stationed,” foreign ministry said China shot flares at least thrice at Bureau of Fisheries and Aquatic Resources (BFAR) plane conducting maritime patrol with Philippine Coast Guard in Zamora (Subi) Reef.
Philippine Coast Guard (PCG) Commodore Jay Tarriela has yet to confirm such report to journalists who did not join latest mission to West Philippine Sea.
However, Beijing’s foreign ministry said in statement China took “countermeasures” against two Philippine military aircraft that flew into its airspace over South China Sea.
It added “Chinese side took necessary countermeasures in accordance with law, in order to protect its own sovereignty and security.”
Foreign ministry did not specify what types of measures China took, describing actions as “professional, restrained, and standardized.”
Meanwhile, PCG spotted “hospital ship” from China, as well as China Coast Guard (CCG) vessel, 24 Chinese maritime militia vessels, Chinese rescue vessel and four Vietnamese vessels around Escoda (Sabina) Shoal.
Tarriela took swipe at officials who allegedly block government’s “transparency initiative” exposes China’s aggression in West Philippine Sea.
In his post on X, spokesman for PCG in National Task Force-West Philippine Sea (NTF-WPS) wrote those “holding position in government and are engaged in either blatant or subtle attempts to hinder our efforts for transparency in West Philippine Sea… are more reprehensible than those who opt to stay silent and refrain from commenting on our fight in West Philippine Sea.”
He did not name any government official.
Tarriela maintained transparency campaign, government includes media on board missions to West Philippine Sea, “has inspired strong sense of patriotism among Filipinos and brought attention to global community regarding China’s illegal activities.”
“International community does not view transparency as form of provocation…instead, they recognize it as commendable effort to hold China accountable for its ongoing and egregious violations of international law,” he said.
He added it is government’s “duty to future generations of Filipinos” to “present factual narrative.”

“We are taking the President’s directive very seriously. .. of national significance, and we will leave no stone unturned in our investigation,” Department of Justice spokesman Mico Clavano said days after their arrest in Indonesia and repatriation to Manila, incorporator of online gaming operator Lucky South 99 and sister of dismissed Bamban, Tarlac mayor Alice Guo underwent inquest proceedings before National Bureau of Investigation (NBI) Special Task Force Division for obstruction of justice and harboring fugitive.
Cassandra Li Ong, incorporator of Lucky South 99, and Sheila Leal Guo were arrested last Aug. 20 by Indonesian immigration authorities at Mega Mall Batam Centre, in Riau, Indonesia.
Two arrived at Ninoy Aquino International Airport via Philippine Airlines Flight PR 540 from Jakarta, Indonesia on Thursday.
Ong is also being investigated by Senate for her involvement in Lucky South 99, Philippine offshore gaming operator (POGO) in Porac, Pampanga raided weeks ago for illegal and criminal activities.
Two are believed to have been with dismissed mayor when she left the country on July 18.
NBI also confirmed Sheila is actually Chinese national named Zhang Mier.
Fingerprint analysis conducted by NBI and BI matched Guo’s fingerprints with those of Zhang Mier.
NBI director Jaime Santiago said at press briefing fingerprint analysis confirmed “ Chinese national Zhang Mier and Sheila Leal Guo are one and the same person.”
He also said Guo would be charged with violating Philippine Passport Act, as her passport was allegedly fraudulently obtained.
Immigration Commissioner Norman Tansingco said Sheila’s use of fraudulently issued passport would be part of immigration violation charges to be leveled against her.
She underwent inquest for offense Thursday night at bureau’s headquarters in Manila. BI is preparing deportation proceedings against Sheila.
“We charged her with misrepresentation as Filipino citizen, fraudulently acquiring Philippine passport,” Tansingco said at briefing.
Sheila’s being Chinese passport holder was only discovered after her arrest in Indonesia, according to Tansingco.
Sheila and Ong were handed over to NBI after spending several hours at BI.
Investigation is still ongoing to determine how Sheila and Ong managed to leave Philippines undetected and whether they had been assisted by Philippine officials.
Meanwhile, Tansingco stressed investigation includes retracing paths taken by Sheila and Ong as they left the country. Specific details about their departure were not disclosed.
Clavano said they have taken steps in compliance with President Marcos’ directive to identify and hold accountable any official found to have helped Alice Guo and her companions leave Philippines.
Santiago, meanwhile, clarified that while charges against Sheila and Ong are bailable, two will remain under detention by virtue of warrants of arrest issued by Senate and House of Representatives.
Santiago also said reglementary period for Sheila and Ong was put on hold because of holiday.
He stated that period will continue on Tuesday at 8 in the morning , two will be turned over to Senate and House.
“Today is holiday, reglementary period does not work because there is no office available, so it will only work from time they were arrested until it starts again on Tuesday,” Santiago said.
Ong’s legal counsel Ferdinand Topacio, however, accused NBI of not following procedures in arrest of his client.
“I asked Santiago basis for arrest was…he said NBI would charge her with crime, but if it’s just charge, then that should go through regular process of filing complaint affidavit with preliminary investigation,” Topacio said.
He argued NBI should not detain Ong without case, emphasizing that she should have been turned over to House of Representatives if there was House warrant for her arrest.
Topacio said NBI’s action was “motivated by higher orders” and that it was plain “lawlessness.”
“There’s no reason for NBI to detain her…they can charge her for anything, but without case, why detain her…these are instructions from above, and it’s plain and simple lawlessness,” Topacio said.
But Santiago explained bureau’s actions, saying NBI was acting on valid warrant.
“When arrest warrant is issued, whether by court, Senate or Congress, it is directed to all law enforcement agencies, and we are one of them… once we apprehend person sought by warrant, we process them and return warrant,” Santiago said. He acknowledged NBI was unable to turn over Ong as it was holiday.

“Based on our intelligence reports, he is still here…we will do everything we can to prevent another Alice Guo,” Interior Secretary Benhur Abalos said, referring to dismissed Bamban, Tarlac mayor who was able to leave the country despite outstanding warrant for her arrest by Senate.
Fugitive alleged human trafficker and sex offender Apollo Quiboloy is still in the country, according to Abalos.
Abalos said they are continuing operations to arrest fugitive pastor and founder of Kingdom of Jesus Christ religious group.
Quiboloy is also wanted by US Federal Bureau of Investigation for sex abuse and human trafficking.
Head of Department of the Interior and Local Government urged Quiboloy to come out of hiding and face the slew of charges against him.
They include qualified human trafficking, sexual abuse of minors and maltreatment charges.
“He is deemed to be innocent until his guilt is proven…it’s best that he surrender, show up and clear everything because these are very serious allegations,” Abalos said.
Abalos and ranking officials of PNP are facing complaints over raid on Quiboloy’s compound in Davao City.

Alice Guo may still be in Indon — BI

“Last monitoring was, they are still in Indonesia…tracking on them is still ongoing and their teams are ready for any operation,” said Bureau of Immigration (BI) spokesperson Dana Sandoval, referring to Indonesia’s immigration authorities following arrest of her sister and alleged cohort in Indonesia, BI expressed belief dismissed Bamban, Tarlac mayor Alice Guo is still in the same country, along with her brother Wesley.
Indonesian authorities arrested Guo’s sister Sheila and Cassandra Li Ong, incorporator of Lucky South 99, identified as Philippine offshore gaming operator (POGO), at the Mega Mall Batam Centre in Riau last Aug. 20.
Sandoval maintained two, along with Guo’s other siblings Alice and Wesley, left country “illegally” as Philippine passport of Sheila Guo she said was “acquired fraudulently” – did not bear any mark or annotation from BI.
Sheila “entered Sabah, Malaysia, which further solidifies our theory that they illegally crossed into Malaysia,” Sandoval stressed.
She also said Sheila and Ong tried to flee Batam Island after entering it on ferry last Aug. 18.
BI spokesperson added Sheila Guo carried Chinese passport, valid until 2031, “with different name and different date of birth, entirely different identity.”
Immigration authorities have sued her for being undesirable alien, subject to deportation, she said.
BI is convinced siblings Alice, Sheila and Wesley Guo, as well as Ong, left the country together, based on luggage tag located bearing name of Alice Guo, as well as matches in their travel history.
Sandoval said BI is “very positive” Indonesian immigration would be able to track down and help bring Alice and Wesley Guo back to the Philippines.
Indonesia’s Ministry of Law and Human Rights said Singaporean national who used to head illegal POGO hub assisted Guo and her companion in Indonesia, according to Presidential Anti-Organized Crime Commission spokesman Winston John Casio.
In a statement, Indonesia’s Ministry of Law and Human Rights said Singaporean identified as ZJ booked four rooms at Harris Hotel Batam Center for Guo, her siblings and Ong.
“From results of checking CCTV ,closed-circuit television, it was found ZJ was party who helped them to make hotel reservations,” Indonesia’s director of immigration supervision and enforcement Safar Godam was quoted as saying in statement.
Casio said ZJ is Zhang Jie, former president of Lucky South 99, illegal POGO hub in Bamban raided by law enforcement agencies last June due to human trafficking and other illegal activities.
With her sister and companion now under custody, “it’s matter of time” before dismissed mayor is arrested and repatriated to the Philippines, according to Sen. Sherwin Gatchalian.
In interview with Senate reporters via Zoom, Gatchalian said based on information he received, Guo is in Batam, Indonesia. “That was her last reported location. It will be very difficult for her to move around Indonesia,” he added.
Details about Alice Guo’s whereabouts and circumstances around their escape on July 18 would be among main issues to be pursued at public hearing of joint committees on justice, human rights; women, children, family relations and gender equality and on public services on Tuesday.
“I’ve been repeatedly saying this: Bamban (POGO) was built with money from unknown sources…if you look at the income statements of Guo-related companies, there are no earnings,” Gatchalian said.
He also said Sheila played “very important role” in the companies, being their treasurer or corporate secretary.
“In Hong Sheng Zun Yuan, Sheila was not there but then again where did funding come from…what role does Sheila play?”
He also said Cassandra was corporate secretary of Whirlwind Corp., owner of the land on which Lucky South 99 was built. “She is representative of Lucky South 99 and she went to PAGCOR ,Philippine Amusement and Gaming Corp) as representative…there is new dimension before because there is angle,” Gatchalian said.
He also said fact that Sheila and Cassandra were traveling together should attest to closeness of Ong to Guo familiy.
Gatchalian also said officials of BI and Civil Aviation Authority of the Philippines would be asked on Tuesday to explain why Guo and her companions were able to leave the country without President Marcos knowing about it.
He said someone from BI admitted knowing about Guo’s departure but failed to inform Palace. The senator said BI Commissioner Norman Tansingco would have lot of explaining to do.
He said Tansingco appeared to have withheld from President information about departure of Guo and her companions for long time.
Justice Secretary Jesus Crispin Remulla, for his part, said it’s best at the moment not to have Guo’s passport canceled as ordered by President Ferdinand Marcos Jr., as doing so might complicate efforts to make her return.
“It’s something that’s little tricky, that’s why we decided to our best judgment to just follow the law on cancellation of passports, which we’ll do later,” he said.
He said if Guo’s passport is cancelled, government would have to issue travel document “would be admission” that she’s Filipino citizen. Guo’s Filipino citizenship is being questioned.
Justice Undersecretary Nicholas Ty, in interview said cancelling Guo’s and her siblings’ passports might have “unintended consequences.” If Guo and her siblings’ passports will be cancelled, “it might make efforts to make them return more difficult,” he said.
Remulla appealed to Guo to return and face qualified trafficking complaint lodged against her.
Justice chief praised BI and National Bureau of Investigation (NBI) for their intelligence gathering and sharing that led to repatriation of Sheila and Ong.
“Victory demonstrates essential role of enhanced cooperation between government forces in ensuring justice is served and peace is safeguarded at all times,” he said.
Authorities revealed Sheila Guo had in her possession Chinese passport valid until 2031.
Remulla also said investigators are looking into liability of individuals and personalities who could have helped Guo and her partners flee.
“If we hold moneyed and entitled people to proper account, it can’t be far to achieving justice for all,” he said.
Philippine National Police (PNP) is keeping tabs on whereabouts of Guo, suspected to be hiding in Indonesia.
Col. Jean Fajardo, spokesperson for PNP, said they continue to monitor Guo’s movements even if she is abroad, in coordination with their foreign counterparts.
Fajardo said they are assisting NBI and other concerned government agencies in investigating Guo siblings and Ong managed to leave Philippines without getting noticed by authorities.
Meanwhile, former senator Panfilo Lacson said arrest of sister and companion of Guo was valid.
“I do not see basis to question warrant of arrest because it is there, it is legal,they have to recognize warrant of arrest, not just judicial warrant issued by court, but warrant issued by upper and lower chambers of Congress ,”Lacson said.
If there are questions regarding their arrest, Lacson said it should be lodged against Indonesian and not Philippine authorities.
“They cannot question Philippine authorities because it was Indonesian authorities who picked them up and deported them to Philippines,” he said.
“Naturally, upon their return, they will be served with warrant of arrest issued by Senate and they should be detained at detention facility of Senate,” he added.
Sheila Guo was subject of arrest warrant issued by Senate, while Ong was ordered arrested by House of Representatives due to their failure to attend ongoing hearings on POGOs.
Lacson said there is already jurisprudence on Congress’ power to detain individuals in relation to conduct of hearings in aid of legislation.

SC to PAGCOR, PCSO: Remit funds to PSC

“Philippine Amusement and Gaming Corporation is ordered to account and remit full amount of 5% of its gross income per annum, after deduction of its 5% franchise tax, from 1993 to present in favor of Philippine Sports Commission,” decision penned by Senior Associate Justice Marvic Leonen read Supreme Court ordered gaming regulator PAGCOR and Philippine Charity Sweepstakes Office (PCSO) to give portion of their income to fund Philippine Sports Commission.
Highest court of the land ruled on petition for mandamus filed by former lawmaker Josseler Guiao in 2016, would compel PAGCOR, PCSO and Office of the President to remit funds to PSC, as mandated by Republic Act 6847 or “Philippine Sports Commission Act.”
In decision high court ruled in favor of Guiao.
“Respondent Philippine Charity Sweepstakes Office is ordered to account and remit to Philippine Sports Commission 30% representing charity fund of proceeds of six sweepstakes or lottery draw per annum, including its lotto draws, for years 2006 to present,” decision stressed.
Guiao accused PAGCOR of not complying with law’s funding requirements. Section 26 states that portion of PCSO’s draws, as well as PAGCOR’s income, would go to supporting athletes in international competitions like Asian Games, Southeast Asian Games and Olympics.
PAGCOR argued, however, sports commission is not entitled to full 5%, since this share is subject to deductions for payment of 5% franchise tax, 50% share of national government, and 10% subsidy to National Power Corporation.
PCSO, meanwhile, argued commission’s allocations come from sweepstakes draws, not lotto games.
However, Supreme Court found sports commission has been “neglected for decades.”
“Without necessary and sufficient funding for Commission, one cannot expect it to efficiently fulfill its functions…moreover, with insufficient funds, entire existence of Commission is made futile and its role in sports development and nation-building rendered nugatory,” high court said in its decision.
Ruling comes amid calls for stronger support for Filipino athletes following historic medal haul in 2024 Paris Olympics. Gymnast Carlos Yulo won two gold medals, while Aira Villegas and Nesthy Petecio won one bronze medal each in women’s boxing.
“We must come up with final list…we have no choice but to finish everything that is pending before us,” Commission on Elections (Comelec) Chairman George Garcia said Comelec intends to resolve all pending petitions concerning accreditation of party-list organizations wanting to participate in May 2025 midterm polls before end of the month.
He said they have set deadline ahead of scheduled raffling of numbers for party-list organizations.
Raffling of numbers means numbers are to be assigned to specific party-lists to be used in their chronological listing in official ballots.
Raffle will be held by second or third week of September.
So far, Comelec data show that there are still 29 petitions of party-lists up for resolution.
There are also 17 Motions for Reconsideration of party-lists that should be resolved.
Comelec has already dismissed petitions of 120 party-list applicants.
Garcia said, “Accredited so far as new party-list groups are 30 organizations.”

‘Avoid’ Red Sea, Ph urges its mariners amid Huthi attacks

“Philippine nationals should avoid area altogether unless absolutely necessary for their livelihood,” foreign ministry said, citing “conflict escalation in Red Sea that poses clear and present danger to all Filipino seafarers working in the area”.
Philippines on Friday urged its mariners to “avoid” Red Sea as Yemen-based Huthi rebels kept up their deadly missile and drone attacks on merchant shipping in the vital waterway.
Foreign ministry said Filipino seafarers should “exercise prudent choice” and their “right-to-refuse sailing” due to risks.
Warning came day after 23 Filipino and two Russian crew members were rescued from Greek-flagged oil tanker that was hit by several projectiles off rebel-held Yemeni port of Hodeida on Wednesday.
Attack on Sounion caused fire and cut engine power.
It was claimed by Yemen’s Iran-backed Huthi rebels, who have waged campaign against international shipping that they say is in support of Gaza during Israel-Hamas war.
Philippines is major supplier of mariners to global shipping industry.
Manila said Thursday Sounion was ninth ship with Filipino crew members that has been attacked by Huthis.
One Filipino remains missing from Red Sea attack on MV Tutor in June, while 17 Filipino crew of Galaxy Leader have remained in Huthi captivity since ship was seized last November.

“AMLC remains committed to upholding rule of law and protecting integrity of our financial system….this case serves as stark reminder that those who engage in laundering proceeds of crime will face full force of the law,” Anti-Money Laundering Council (AMLC) executive director Matthew David said Regional Trial Court Branch 56 of Angeles City has found drug laboratory operator Xinli Chen guilty of 35 counts of money laundering..
Chen was convicted for violating Section 4(a) of Republic Act 9160, or Anti-Money Laundering Act of 2001, and sentenced to seven to 14 years of imprisonment for each count and fined P3 million per offense.
Chen was arrested on Sept. 7, 2016 during raid by Philippine Drug Enforcement Agency and Pampanga Provincial Police Office on hidden drug laboratory within piggery in Pampanga.
Follow -up financial investigation by AMLC revealed Chen’s money laundering activities, including use of multiple bank accounts to hide illegal profits from drug operations.
David said conviction is significant achievement in government’s ongoing battle against money laundering linked to illegal drug activities.
Financial Action Task Force retained Philippines on its gray list for third straight year as country has yet to adequately address concerns over deficiencies in the country’s measures against money laundering and terrorism financing.

Crew with 23 Fils rescued from stricken oil tanker in Red Sea

“All on board MV Sounion were subsequently rescued and are being transported to Djibouti, nearest safe port of call,” EU naval Aspides mission said in statement on social media platform X oil tanker’s crew has been rescued after attack in Red Sea off Yemen but stricken ship now poses “environmental hazard”.
Several projectiles hit Greek-flagged Sounion off rebel-held Yemeni port of Hodeida, causing fire and cutting engine power, according to UKMTO maritime agency run by Britain’s Royal Navy.
Attack was claimed by Yemen’s Iran-backed Huthi rebels, waged campaign against international shipping that they say is in support of Gaza during Israel-Hamas war.
In statement, Huthis said Sounion “belongs to company that has ties with Israeli enemy” and was “accurately and directly hit” with drones and missiles.
European Union’s Aspides mission sent ship to rescue crew of vessel, carrying 150,000 tonnes of crude oil.
Later on Thursday, UKMTO said: “vessel is now at anchor and all crew have been evacuated.”
The Sounion, owned by Greek shipping company Delta Tankers, carried crew of 25 people, including 23 Filipinos and two Russians, according to Greece’s ports authority.
Unmanned vessel is now anchored in Red Sea between Eritrea and Yemen, according to Joint Maritime Information Centre (JMIC), run by Western naval coalition.
EU naval force, formed in February to protect merchant vessels in Red Sea from attacks by Huthi rebels, warned that ship “now represents navigational and environmental hazard”.
“It is essential that everyone in the area exercises caution and refrains from any actions that could lead to deterioration of current situation,” it said.
According to JMIC, ship was abandoned and fire was reported to be contained, with one crew member sustaining minor injury.
Greek ports authority said ship had departed from Iraq and was destined for port near Athens where many refineries are based.
Delta Tankers said “plans are in place to move vessel to safer destination where full assessment checks and any repairs can be undertaken”.
It did not specify where ship would be taken to.
This is third Delta Tankers vessel attacked in Red Sea this month, after Delta Blue and Delta Atlantica, according to shipping data.
It is also latest involving Philippines crew. One Filipino remains missing from Red Sea attack on MV Tutor in June, while 17 Filipino crew of Galaxy Leader have remained in Huthi captivity since ship was seized last November.
