FMJ skips COP28, Citing hostage situation

“In light of important developments in  hostage situation involving 17 Filipino seafarers in  Red Sea, I have made decision not to attend COP28 in Dubai,” President Ferdinand Marcos Jr.  said in post on his official X account.

It was  first time FMJ  had canceled  official foreign trip since his election as President in June last year.

Marcos was to meet with his officials to discuss  dispatch of  high-level delegation to Tehran to extend assistance to Filipino seamen.

Only  members of his Cabinet, including Interior Secretary Benhur Abalos, Labor Secretary Bienvenido Laguesma, Trade Secretary Alfredo Pascual, Finance Secretary Benjamin Diokno and Socioeconomic Planning Secretary Arsenio Balisacan showed up at  Villamor Air Base for send-off ceremony.

Secretary Ma. Antonia Yulo-Loyzaga of the Department of Environment and Natural Resources will represent Marcos at  COP28 and deliver his administration’s statement on climate change.

Loyzaga is the official representative of the President to  Climate Change Commission. FMJ chairs CCC.

“I have entrusted DENR Secretary Ma. Antonia Yulo-Loyzaga to lead  COP28 delegation and articulate  country’s statement on my behalf,” FMJ said. COP28 runs until Dec. 12.

In  statement, Loyzaga said  Philippines will strongly press for  implementation of  compensation fund for developing countries that have suffered  most from climate change.

She said  establishment of Loss and Damage Fund is among  priorities of  13-day COP28,  opened at  Dubai Exhibition Centre.

“ Loss and Damage Fund is extremely important because there are climate-related adverse impacts beyond our ability to finance,” Loyzaga said.

Developed countries and private sources would be called upon to contribute to  operationalization of  fund in  timely and locally driven manner, Loyzaga added.

Countries agreed to set up such fund in last year’s COP27 climate conference in Egypt.

“Climate finance is  huge theme in COP28…we are working in seven major negotiating work streams: loss and damage, climate finance, adaptation, global stocktake,  just transition, especially of our labor towards  renewable energy future, but also specifically our concerns about reskilling and upskilling our workforce… finally, mitigation and Article 6 of  Paris Agreement, for greenhouse gas (GHG) emissions reduction and avoidance,” Loyzaga said.

Transitional  committee working out  details of  fund,  reportedly failed to issue  set of recommendations on how to set it up and make it operational.

Developed countries, led by  US, want  fund to be based at  World Bank, while developing nations said this would make it hard for them to tap into  funding.

Loyzaga added Philippines is at point  it would need to do  thorough review of  country’s commitment to  75 percent GHG emission reduction.

“I think it is extremely important for us to be heard by other countries because what we’re trying to do is really approach our climate resilience by twinning adaptation, mitigation, and disaster risk reduction. .. that will involve  social, economic, environmental, and scientific efforts of our whole government,” she said.

Paris Agreement calls for keeping global warming in check by limiting temperature rise to no more than 1.5°C, and  reduction of GHG emissions by 45 percent by 2030, to reach net zero by 2050.

Net zero means bringing down global GHG emissions to almost zero, while  residual or remaining GHG emission is captured or absorbed, mostly by forests,  sequester carbon dioxide,  major GHG.

“Our participation in COP28 seeks to amplify calls for developed nations to fulfill their commitments to developing countries in  areas of climate finance, technology transfer, and capacity-building,” Loyzaga said.

“Moreover, our exposure internationally will open opportunities for access to financial and technical support  we need as  country vulnerable to climate change.”

In  speech  at Malacañang, FMJ stressed  significance of  Philippines’ participation to  COP28, saying it’s  “biggest platform for  international community where all stakeholders will have all-hands-on-deck to address climate change and help mitigate its impact.”

In 2022, CCC vice chairperson and executive director Robert Borje said Philippines incurred P506.1-billion losses in  past decade due to climate change and geological hazards.

More than 140 heads of state, government and royalty were expected to attend  opening  of  World Climate Action Summit at  Dubai Exhibition Centre.

At pre-departure briefing  at Malacañang, Foreign Affairs Assistant Secretary Maria Teresa Almojuela said high on agenda of Marcos administration at this year’s COP were fast tracking  energy transition, delivering and enhancing climate finance, and adopting resilient food systems.

Prior to Marcos’ decision to skip  annual climate gathering, several bilateral meetings were also being arranged between Marcos and other world leaders on sidelines of COP28, Almojuela said.

She said  Philippines has  total of 237 registered on-site delegates, representing 16 agencies and members of civil society.

“Many of them ,Filipino delegates will be staying behind after  President has completed his program for negotiation … usually it extends beyond two or  couple of days beyond  schedule because these are very important conversations,” Almojuela said.

In his speech during  turnover of P541.44-million People’s Survival Fund (PSF) to six local government units at Malacañang, FMJ would use COP28 to call on global community to stay committed to climate change mitigation programs.

“We will use this platform to rally to global community and call upon nations to honor their commitments, particularly in climate financing,” he said.

FMJ underscored  significance of  COP28 to  Philippines, one of the most vulnerable countries to  effects of climate change in the world.

“But we must also take lead when it comes to  global move and  global aspiration  those most vulnerable communities around the world will somehow be assisted by developing countries when it comes to these measures to mitigate and to adapt to climate change,” he added.

PSF finances climate change projects not funded by other government agencies.

Among activities eligible for PSF funding are projects on water resources management, land management, agriculture and fisheries, and health.

17 hostage sailors ‘in good condition’

“Government sources say  hostages are in good condition, and will eventually be released…efforts are ongoing for this to happen as soon as possible,” Department of Foreign Affairs (DFA)said in  statement  17 Filipino seafarers being held hostage in  Red Sea by Yemen’s Houthi militants are expected to be freed soon.

This developed as President Ferdinand Marcos Jr. canceled at  last minute his attendance at  28th Conference of  Parties to  United Nations Framework Convention on Climate Change (COP28) to work on  safe release of  Filipinos.

“In light of important developments in  hostage situation involving 17 Filipino seafarers in  Red Sea, I have made  decision not to attend COP28 in Dubai Friday,” FMJ said in  post on his official X account, more than an hour before his scheduled departure. FMJ did not arrive at  Villamor Air Base in Pasay City, where he was scheduled to deliver  departure speech ,also did not provide additional details in his post on X.

He  was to meet with his officials  to discuss dispatch of  high-level delegation to Tehran, Iran to extend assistance to  Filipino seamen.

“Today, I will be convening  meeting to facilitate  dispatch of  high-level delegation to Tehran, Iran, with  aim of providing necessary assistance to our seafarers,” he said.

17 Filipinos were among  25 crewmen of cargo vessel Galaxy Leader seized by Houthi militants in the southern Red Sea on Nov. 19.  Other  crewmembers of  cargo ship were Ukrainians and Mexicans.

Satellite imagery released on Nov. 28 showed  Galaxy Leader near Yemen’s port city of Hodeidah.

Houthi military spokesman Yahya Saree said  seizure of  ship was in response to  “heinous acts against our Palestinian brothers in Gaza and  West Bank.”

Bahamas-flagged, British-owned Galaxy Leader reportedly has links to Israeli businessman Abraham Ungar, and is operated by  Japanese firm. Israeli Prime Minister Benjamin Netanyahu’s office denied  ship has Israel links.

Pasay coastal projects complied with environment standards

“There were several technical conferences called because there were some findings and observations…  projects complied with what was required ,documentation-wise and then review-wise, as well, overall  DENR actually submitted report and they had in fact substantially complied,” Environment Secretary Antonia Yulo-Loyzaga said at press briefing in Malacañang two projects of  Pasay Eco-City Reclamation have been allowed to resume because they complied with  requirements set by the government.

Loyzaga added  DENR undertakes compliance review process, involves taking a look at  environment compliance certificate and area clearances of project.

DENR agency also conducts  cumulative impact assessment, scientific analysis needed to determine effect of projects in terms of fulfillment of its mandamus order as lead implementing agency.

“So what we are able to do is evaluate and assess compliance…we do not suspend, we do not lift suspension , matter for PRA,Philippine Reclamation Authority,” Loyzaga said.

Allowed to resume were  265-hectare Pasay Harbor City Reclamation Project,joint venture with Pasay Harbor Corp., and 360-hectare Pasay Reclamation Project,  jointly undertaken with SM Smart City Infrastructure and Development Corp.

House panels OK res for Ph coop with ICC

“By allowing ICC to come, it’s telling the world  we have nothing to hide here,” through overwhelming voice vote, officials and members of  joint committee on justice and human rights adopted House Resolution 1477 of Manila 6th District Rep. Bienvenido Abante Jr. , 1-Rider party-list Rep. Ramon Gutierrez, and consolidated House Resolution 1482 of Albay 1st District Rep. Edcel Lagman.

Abante, also chairs  committee on human rights of the House, said two committees of House of Representatives have approved and consolidated resolutions encourage President Ferdinand Marcos Jr. to allow  Philippines to cooperate in  International Criminal Court (ICC)’s probe into Duterte administration’s war on drugs.

Executive Secretary Lucas Bersamin, meanwhile,  did not think FMJ intended to have  country rejoin ICC anytime soon.

Senators including Ronald dela Rosa, main enforcer of war on drugs when he was police chief, had  “casual dinner” with the President and First Lady Liza Araneta Marcos at Malacañang. It was unclear if ICC issue was among main topics discussed.

Legislators  filed  resolutions last Nov. 21, aiming to allow  ICC entry into the country.

Dela  Rosa only wants to demonstrate  country’s justice system is functioning efficiently, contrary to claims made by some.

“We just want to show  whole world and to  ICC our justice system is running smoothly,” Dela Rosa said.

Lagman, president of opposition Liberal Party and  vocal critic of former president Rodrigo Duterte, maintained letting ICC in is not surrender of sovereignty but exercise of it.

“If we believe in  rule of law, then we must let ICC come in,” Lagman said.

He contended allowing ICC to investigate does not compromise national sovereignty.

Philippines withdrew its ICC membership in 2017 following investigation into alleged “crimes against humanity” related to casualties in government’s war on drugs, as ordered by Duterte, whose term started in 2016 and ended middle of last year.

When FMJ said  proposals to return to  ICC are “under study,” he does not mean  country would be rejoining very soon, according to Executive Secretary Lucas Bersamin.

Bersamin believe Marcos’ response only meant  he did not want to give immediate answers to proposals for the country to rejoin  ICC.

“Well, you cannot just close doors on these discussions, but I am sure  what the President means is that it cannot be  knee-jerk reaction that we can put forward anytime we are asked  question like this,” the executive secretary said.

He stressed  while he could not second-guess the President in answering to these proposals, “in my view, as far as I know him, he does not mean  we are going back to  ICC very soon.”

“But when Marcos says ‘he is studying,’  something  you say  you do not react too quickly…you have to look at the consequences,  long-term effects,” Bersamin said.

In making decisions, the President “listens to his own conscience, to his own heart, that is something we have to appreciate in him,” according to  former chief justice, noting FMJ is “ very prudent leader and is not prone to rush to judgment.”

“Personally, I do not see any reason for us to go back to  ICC because  Philippines already has functioning justice institution and that  procedures are in place. ..if crimes are committed,  government investigates, ICC is for lawless countries or lawless dictators…but we do not have dictator, we have  democratically elected President,” the executive secretary said.

Also, not all countries are members of ICC, Bersamin pointed out.

Meanwhile, Solicitor General Menardo Guevarra has reiterated  Philippines has “no legal duty” to cooperate with  ICC in its investigation of Duterte administration’s bloody drug war.

“ ICC can no longer exercise its jurisdiction after  effectivity of  Philippines’ withdrawal from  Rome Statute in 2019,” Guevarra told reporters.

He issued remark in light of resolutions filed in Congress urging  government to cooperate with ICC’s investigation into drug war killings.

He said even if  resolutions are adopted, they are only “non-binding expressions” of Congress’ sentiment.

On issue of Philippines rejoining  ICC as  member-state, Guevarra said  policy decision needs “very serious study because many factors and competing interests need to be considered.”

Investigators from  Hague-based ICC are free to come to the Philippines to investigate allegations of extrajudicial killings, but they cannot expect authorities to cooperate on  basis that  government has issues with regard to jurisdiction.

Guevarra made this crystal clear to members of  House of Representatives who endorsed separate resolutions calling on Marcos administration to rejoin ICC.

“Your resolutions urge  President to cooperate, but final say of whether, in fact, government will cooperate will be with the President …we will not cooperate, but we will not stop ICC investigators from doing their job”  country’s chief government lawyer, served as Department of Justice secretary and deputy executive secretary during Duterte’s term said.

Senior Deputy Speaker Aurelio Gonzales Jr.  respects opinion of Dela Rosa,  PNP chief when Duterte took over reins of government in mid-2016.

“We respect his opinion, but we ask for parliamentary courtesy…as he very well knows, House is mandated to act on resolutions filed by its members regardless of political affiliations in the same manner  Senate takes action on measures presented by senators,” Gonzales added.

Department of Justice is open and waiting for legal opinion on ICC issue Vice President Sara Duterte-Carpio said she would send to DOJ.

“We will include her note and comments therein as part of considerations and study,  issue is multi-faceted, and we must see things from a holistic perspective. In all this discussion, let us not forget that the goal is to attain justice for victims of extrajudicial killings. Plain and simple,” DOJ spokesman Mico Clavano said.

Duterte would urge DOJ not to cooperate in ICC’s investigation, saying her office would continue to assert its position and would lay down their legal basis.

Vice President, however, maintained  position of Marcos on the issue should be respected.

ICC decided to resume its inquiry into  Philippines’ war on drugs last January.

Senators Ramon Revilla Jr. and Bong Go posted on their official social media accounts pictures of dinner held at Bahay Pangulo.

Senate President Juan Miguel Zubiri joined dinner with Senate President Pro Tempore Loren Legarda; Senate Majority Leader Joel Villanueva; Senators Imee Marcos, Sonny Angara, Jinggoy Estrada, Raffy Tulfo, Lito Lapid, Alan Peter Cayetano, Pia Cayetano, Mark Villar, JV Ejercito, Francis Tolentino, Nancy Binay, Grace Poe, Cynthia Villar with her husband former Senate president and entrepreneur Manny Villar, Revilla, Go and Dela Rosa.

Former Senator Leila de Lima said individuals against  Philippines rejoining ICC are primarily serving  interests of former President Rodrigo Duterte.

The former justice secretary said  rejoining ICC is “right thing” to do, saying  2019 withdrawal was “questionable” for it “served  interests of one man.” 

“Here we are, dahil may isang taong gustong umiwas sa accountability, bigla niyang winithdraw so anong problema ngayon sa pagbalik natin which is  right thing to do?”  De Lima said in interview with reporters after  court hearing at Muntinlupa Regional Trial Court Branch 206. 

De Lima  is hopeful  government will have “positive” stance toward rejoining tribunal. 

Before her arrest on Feb. 24, 2017, De Lima had spent  decade investigating “death squad” killings allegedly orchestrated by Duterte during his time as Davao City mayor and in  early days of his presidency.

As Duterte and his allies sought to silence De Lima, she was ousted from  Senate and imprisoned on three drug trafficking charges. Two of the charges have been dismissed.

Mali, Philippines loneliest elephant, 49

Elephants have  potential lifespan of up to 75 to 80 years. Mali, Philippines’ only elephant is believed to have been 49 years old at the time of her death.

Mali, died at  Manila Zoo.

Manila Mayor Honey Lacuna-Pangan announced Mali’s death in  video posted on social media by  city’s public information office.

Pangan said Mali died at around 3:45 in the afternoon.  Necropsy  will be conducted to identify  cause of Mali’s death.

Mali was sent as  gift by Sri Lanka in 1977 to  city of Manila when she was three years old after she was found orphaned in the wild.

Mali had received  larger enclosure in  zoo, which reopened in 2021 after extensive renovation.

Elephant, full name Vishwa Ma’ali, gained international attention in 2017 when  animal rights group described her as  loneliest elephant in the world.

In 2021, group called on then mayor Isko Moreno to allow Mali to stay with other elephants at  sanctuary in Thailand.

Moreno had vowed to bring in more elephants to keep Mali company.

4 kidnapped Chinese siblings body found

“Their DNA profile matched that of their mother’s,” Philippine National Police (PNP) public information officer Col. Jean Fajardo said four of the six Chinese who were kidnapped by armed men from Ayala Alabang Village in Muntinlupa City last October are dead.

Fajardo said two of the victims were found dead in Infanta, Quezon on Nov. 6.

Victims  siblings, were identified through  DNA samples provided by their mother, Fajardo said in  news briefing at Camp Crame.

Remains  of two other victims were dumped in Rodriguez, Rizal, Fajardo added.

Anti-Kidnapping Group identified  victims through  clothes they wore when they were kidnapped on Oct. 30.

Fajardo said they are waiting for  results of DNA testing for confirmation of their identities.

Two other victims remain missing.

Victims  and their three Filipino companions were snatched by armed men from  house along Sampaca street at around 4 in the morning.

Police said  victims were held at gunpoint, blindfolded and forced into  Toyota Hi-Ace van.

Filipinos were released in Barangay Limao in Calauan, Laguna on the same day. They reported  kidnapping incident.

Fajardo said they have identified persons of interest in the kidnapping and murder of victims but declined to give other details due to  ongoing investigation.
