“We were given 15 days to file our response, but ang problema nito binigyan kami ng pagkakataon mag-respond but may suspension na,” Sonshine Media Network International (SMNI) counsels Mark Tolentino and Rolex Suplico told journalists violation of Constitution and abuse of power.
SMNI asked Court of Appeals to stop National Telecommunications Commission from implementing 30-day suspension NTC imposed on the network for alleged franchise violations.
Tolentino and Suplico filed petition for certiorari, asking for temporary restraining order on NTC order, issued on Dec. 21 and was immediately executory.
In petition, SMNI said order violated several provisions of Constitution, including right to due process and freedom of speech as well as separation of powers.
Suplico said suspension order was issued even as SMNI has yet to respond to complaint filed against it.
SMNI said suspension violated due process clause of Constitution and separation of powers between executive and legislative as NTC “surrendered” its authority to House of Representatives, earlier called for suspension of network.
Early this month, House committee on legislative franchises adopted resolution urging NTC to suspend franchise of SMNI.
Committee cited numerous violations of terms and conditions of franchise, stemmed from SMNI’s alleged dissemination of fake news and red-tagging.
House, in its hearings, found network violated its franchise thrice, when it allegedly failed to obtain congressional consent for change of ownership of its shares of stock, distribute 30 percent of its ownership to public and fulfill its responsibility to public when it supposedly spread misinformation and threats.

“We received reports that around 100,000 tons of imported rice have already arrived in the country…. part of 495,000 MT committed by import permit holders to Agriculture Secretary Francisco Tiu Laurel,” Department of Agriculture (DA) Undersecretary Roger Navarro said in statement nearly 500,000 metric tons of rice from Taiwan and India will arrive beginning this month until February 2024.
This is in preparation for possible impact of El Niño phenomenon on palay production.
Meanwhile, total of 20,000 bags equivalent to 1,000 MT delivered before Christmas Day constituted first batch of 40,000 bags of rice donated by Taiwan, Navarro said.
Another 75,000 MT will arrive from India starting this week until early January, DA usect l said.
“ 75,000 MT due in coming weeks is part of 295,000 MT of rice India has allocated to Philippines,” Navarro said.
In October, India approved export of over one million MT to seven countries, with Philippines getting over 28 percent of export allocation.
“With arrival of imported rice and volume harvested by farmers in recent months, country will have sufficient supply of national food staple until next harvest starts in March,” Navarro noted.
These imported rice will be slapped with import duty of 35 percent, he said.
He noted that country’s daily rice consumption is 36,000 MT per day, or 1.08 million tons monthly.
Economic managers, especially Bangko Sentral ng Pilipinas (BSP), are closely watching rice supply situation due to its impact on inflation.
BSP has aggressively raised interest rates since last year to tame inflation, affects purchasing power of consumers and undermines economic growth.
Based on monitoring of DA, retail price of local regular milled rice was pegged at P52 per kilo; local well-milled rice, P56 per kilo; local premium rice, P62 per kilo and local special rice, P68 per kilo.
Imported well-milled rice was sold at P58 per kilo; imported premium rice, P61 per kilo and imported special rice, P65 per kilo.
Rice watch group Bantay Bigas said extension of low tariffs on commodities, particularly on rice, under Executive Order 50 only shows measures did not deliver goal of lowering prices.
“Consumers did not feel effect of low tariff but price of food products continues to rise, especially rice,” Bantay Bigas spokesperson Cathy Estavillo said.
She said this extension will only serve interests of importers and traders and will result in billions of forgone government revenues.
“Our call remains to strengthen local production through support services and subsidies to farmers, post-harvest facilities and issue EO to stop implementation of Republic Act 11203 (Rice Tariffication Law) so that trading function of National Food Authority can be immediately restored… NFA can buy significant volume of farmers’ produce, we will also call for immediate release of P12-billion fund from Rice Competitiveness Enhancement Fund and distribute it to farmers…we call on different sectors and agricultural stakeholders to unite against re-extension of low tariffs,” Estavillo said.
Meanwhile, former agriculture secretary Leonardo Montemayor criticized decision to extend lower tariffs on rice, corn and pork until end of 2024, saying for the last three years of its implementation, hog raisers and farmers suffered from yearly leeway given to imported agricultural commodities but which did not benefit consumers and government.
“It has also caused Bureau of Customs, government billions of revenue losses,” Montemayor said.
He said t if economic managers will solely depend on lower tariffs, target of affordable food will not happen and should be done is strengthen local production if government wants cheaper agricultural commodities for Filipinos.
“Based on our experience in the last three years as lower tariffs started in middle of 2021, during time of former president Rodrigo Duterte, it failed to bring down retail prices of rice, corn and pork, even with tariff of 35 percent or 40 percent for in quota or out quota, retail prices of pork should not exceed P300 but cheapest imported pork was pegged at P400 and above, what is guarantee extension of lower tariffs will benefit consumers… on the part of farmers, it affects their production,” Montemayor said.
Montemayor also backed imposition of suggested retail price on pork to prevent overpricing in the market.
He added promise of affordable prices for consumers does not happen, same with rice, based on monitoring of DA in Metro Manila markets, imported well-milled and regular milled rice were not available as imported premium rice was sold for as high as P60 per kilo and imported special rice, P66 per kilo.
At the same time, Montemayor said farmers will be further affected by lower tariff on imported corn as prevailing price in world market was only P14 to P15 per kilo compared to P19 per kilo for locally produced corn.
“Even if you impose tariffs, retail price of imported corn will be P16, P17 per kilo… will affect retail price of corn, especially with lower tariffs,” he noted.
For his part, Philippine Pork Producers Federation president Nonon Tambago said move to extend lowering of tariff has further affected confidence of local swine farmers amid slump in farmgate price as it reached P175 per kilo.
“We are deeply disappointed with decision to extend lower tariff on pork until Dec. 31, 2024…over the past three years, multiple executive orders have been issued to lower tariffs, but they have not achieved goal of making pork more affordable for consumers,” Tambago told media.
He noted despite decrease in farmgate price, retail price remains high at P350 per kilo.
“Instead of focusing solely on lowering tariffs, it is crucial to address gap between farmgate and retail prices as part of long-term solution…important for economic managers to consider real situation faced by thousands of local farmers, rather than consistently favoring few importers and traders,” Tambago added.
Samahang Industriya ng Agrikultura executive director Jayson Cainglet said it was unfortunate economic team succeeded in convincing President Ferdinand Marcos Jr. to issue EO 50.
“Here in the Philippines it is reverse…local producers are penalized and importers are rewarded and pampered with four straight years of reduced tariffs on rice, pork and corn,” Cainglet said.

“We believe his body has now been transferred to Seoul National University Hospital,” Seongbuk police station said South Korean actor Lee Sun-kyun, best known for his role in Oscar-winning film “Parasite,” was found dead in apparent suicide, he was 48.
Lee was found inside vehicle parked on street in Seoul’s mid-northern Seongbuk district.
South Korea’s Yonhap news agency reported, citing police, that Lee had left “note that reads like will.”
Lee had been under police investigation over his alleged use of marijuana and other drugs.
Once celebrated for his wholesome image, local news outlets reported that Lee was being dropped from television and commercial projects following scandal.
Graduate of South Korea’s prestigious Korea National University of Arts, Lee made his acting debut in 2001 in a television sitcom titled “Lovers.”
He later won acclaim for his performances in variety of roles, including charismatic chef and genius neuroscientist who is incapable of empathy and responsibility as both adult and professional.
Globally, he is best known for his portrayal of wealthy and shallow patriarch in director Bong Joon-ho’s 2019 Oscar-winning film “Parasite.”
He was also recognized for his performances in romance flicks, such as 2007 TV drama “Coffee Prince” and 2012 film “All About My Wife.”
His last film, this year’s horror flick “Sleep” , he played husband whose sleepwalking eventually leads to terrifying circumstances was well-received and featured in Critics’ Week section at Cannes festival.
Devastated fans expressed their grief on social media, with one user writing on X: “I laughed and cried a lot while watching your acting…t hank you.”
Renowned Korean-American writer Min Jin Lee joined others in expressing their condolences.
“Lee was praiseworthy in ‘Parasite’ and exceptional in ‘My Mister,’” she wrote on Instagram.”May he be remembered for his excellent work and creative gifts.”
Lee’s reputation suffered significant blow when South Korean authorities launched investigation into his alleged drug use in October.
He had been suspected of using illicit drugs at residence of hostess employed at high-end bar in Seoul’s glamorous Gangnam district.
According to Yonhap, Lee asserted the was “tricked” by the hostess into consuming drugs and was unaware of their illegal nature.
From Dec. 23 to 24, he attended his third police investigation session, which lasted 19 hours, Yonhap reported.
He briefly spoke to reporters in late October before entering police station in Incheon to meet with investigators.
“I sincerely apologize for causing great disappointment to many people by being involved in such an unpleasant incident, I feel sorry for my family, which is enduring such difficult pain at this moment…once again, I sincerely apologize to everyone,” he said at the time.
South Korea has extremely tough laws on illegal drugs, with Koreans who take drugs such as marijuana legally abroad risking prosecution upon returning to their home country.
Lee is survived by his wife, actress Jeon Hye-jin and two sons.
De Lima hit DOJ’s refusal to transfer 11 inmate-witnesses from Sablayan to NBP

“Until very last moment, this agency which I also led for five years opposed my application for bail, despite its willful and deliberate use of manufactured evidence and perjured witnesses just to sustain Duterte’s persecution cases against me,” Former Sen. Leila De Lima, who was also former justice secretary, said in statement posted on X reacted to Department of Justice’s (DOJ) refusal to transfer 11 inmate-witnesses on her last drug case.
In statement, she said DOJ’s remark shows justice department’s “continuing attempt to stand by its former secretaries.
This statement was issued a day after DOJ discouraged transfer of inmate-witnesses saying that they are convicted felons and emphasizing recantation does not warrant “reward.”
“DOJ wants to prevent them from testifying again in court on their recantations to stop identification of DOJ officials who played crucial role in forcing them to lie & fabricate evidence in my cases,” she said.
Muntinlupa Regional Trial Court Branch 206 approved transfer of the 11 inmate witnesses from Sablayan Prison Camp to New Billibid Prison in Muntinlupa City.
Among 11 witnesses are four persons deprived of liberty prosecution also recommended being transferred for “smooth and easy access.” DOJ raised concern over this, questioning credibility of witnesses.
De Lima, meanwhile, remarked DOJ supported inmate-witnesses when it served their agenda but is now discrediting them, labeling them as convicted felons, and questioning credibility of their recantations.
“DOJ also says these are not ordinary witnesses, but convicted felons. ..that is what we’ve been telling DOJ since Day One…as convicted felons, they’re not ordinary witnesses, but they are also disqualified from testifying as state witnesses under Witness Protection Law,” De Lima said in her statement.
It can be recalled one of the witnesses include former Bureau of Corrections officer-in-charge Rafael Ragos who recanted his testimony against De Lima in April 2022. He said that former justice secretary Vitaliano Aguirre coerced him to testify against former senator. Aguirre denied all accusations of Ragos.
On November 26, Court of Appeals (CA) reversed Ombudsman’s dismissal of De Lima’s complaints against Aguirre and former justice secretary Menardo Guevarra over use of convicted criminals as state witnesses in her drug cases.
CA said Ombudsman had committed grave abuse of discretion when it dismissed complaints based on “inapplicable exemptions.”
Meanwhile, DOJ spokesman Assistant Secretary Mico Clavano reacted to De Lima’s remark and said DOJ is just doing ” right thing.”
“We are only doing what we think is the right thing to do. Nothing more, nothing less,” he told media.
In her statement, De Lima also argued inmate-witnesses are under jurisdiction of Muntinlupa RTC as they are witnesses in pending case before it.
“RTC of Muntinlupa clearly has jurisdiction over these inmates for simple reason they are witnesses in case pending before it and that it is in the interest of administration of justice that court is assured they are safe & free in their testimony,” De Lima, who served as DOJ secretary from 2010 to 2015, said in her statement.
DOJ said Bureau of Corrections (BuCor) holds jurisdiction over “custody and management” of inmate-witnesses.
“Sa tingin ng department, yung authority, custody nitong mga witnesses ay nasa BuCor dahil before they were witnesses, they were convicted felons and karamihan diyan ay naconvict of heinous crimes,” Clavano said in Zoom press briefing with reporters.
Clavano also said DOJ is looking into legal steps to hold inmate-witnesses in Sablayan.
In response, De Lima said DOJ should prioritize in protecting truth and not concealing it.
“Hindi dapat matakot ang DOJ sa ibubulgar ng mga inmate-witnesses na dati na nilang ginamit para maipakulong ang isang inosenteng tao nang halos pitong taon…katotohanan ang dapat una nitong itinataguyod at pinoprotektahan, hindi ang pagtatakip nito,” De Lima said.

“DOLE is supporting modernization program so that our jeepney drivers can be treated like regular workers who have fixed salary rate and are covered by social benefits such as SSS and PhilHealth,” Labor Undersecretary Benjo Benavidez said in interview, Department of Labor and Employment (DOLE) is pushing for regular employment status of jeepney drivers who will continue working under jeepney modernization program.
He noted DOLE will not issue new guidelines and instead will adopt existing department order governing employment and working conditions of drivers and conductors in public utility bus transport industry.
2012 department order issued by DOLE provides fixed salary and benefits mandated bye Labor Code to bus drivers.
He added DOLE has capacitated Land Transport Franchising and Regulatory Board on adoption of same policy for jeepney drivers and operators.
