Gov’t. can’t track source of P6.1 B for Bamban POGO

“POGO hub in Bamban is no small development… 10-hectare property, there’s shopping mall, there’s condominiums and there are 37 buildings in that POGO hub… P6.1 billion was ploughed in… concerning part is, government did not detect anything in terms of money flows,” Sen. Sherwin Gatchalian said government agencies including Anti-Money Laundering Council (AMLC) were unable to trace source of estimated P6.1 billion spent for construction of expansive Philippine offshore gaming operation (POGO) hub in Bamban, Tarlac.
He said senators asked representatives from AMLC on the matter during executive session.
Bamban Mayor Alice Guo, business permit and licensing officer Edwin Ocampo and municipal legal officer Adenn Sigua have been placed under preventive suspension by Office of the Ombudsman based on results of investigation by Department of the Interior and Local Government linking POGO hub to illegal activities.
“When we were doing our own investigation, we couldn’t find any trace on how P6.1 billion landed on our shores…we couldn’t find any trace on who built facilities, we were very disappointed with answers of Anti-Money Laundering Council because they couldn’t trace how money came in and they couldn’t trace who received money and dispensed money during construction stage,” said Gatchalian.
Gatchalian has urged President Ferdinand Marcos Jr., as chair of National Security Council (NSC), to declare POGOs as national security threat.
He cited information from security and intelligence agencies, reported extent of influence of POGOs in the country.
He noted that those behind operations “managed to increase their influence to different personalities and groups, particularly political personalities, enforcement groups and enforcement agencies, as well as local criminal syndicates.”
“POGOs are run by foreign criminal syndicates, and based on their intelligence, they are now aligning themselves with local criminal syndicates,” senator said.
He warned that money coming into Philippines can be used to gain influence or protection from local officials.
“Big sums of money are coming in our country undetected and that can be used for whatever purpose, to build more POGO hubs, but definitely it will also go to political personalities and other personalities in order for them to gain protection for their illegal activities,once they get foothold to all our decision makers, then it’s very difficult now to fight POGOs or to untangle all of criminal activities of POGOs because they have deeper influence in our government system,” said Gatchalian.
Once declared national security threat, Gatchalian said Marcos would have power to cancel existing licenses and prevent future licenses from being issued.
He also underscored need to hold local agencies to account, particularly Philippine Amusement and Gaming Corp. (PAGCOR), mandated to regulate POGO operations in the country.
Camp of Guo, meanwhile, is asking Office of the Ombudsman to lift her six-month preventive suspension over her alleged link to POGO hub in her municipality.
In her 31-page motion for reconsideration, Guo argued that conditions for her preventive suspension are not present in case against her and that contrary to assertions of Ombudsman and Department of the Interior and Local Government (DILG), the evidence of her guilt “is not strong.”
The mayor also asserted there was no substantial evidence to prove all elements of charges against her: grave misconduct, serious dishonesty, gross neglect of duty, and conduct prejudicial to the best interest of the service.
“It is most respectfully submitted that none of above-mentioned elements of administrative charges are present in instant case…all of acts complained of, albeit extremely distorted and exaggerated, are done within bounds of law and as part of sworn duty of respondent Guo as local chief executive of her municipality,” motion read.
“Evidence against respondent Guo does not rest on substantial evidence considering allegations in complaint have no basis either in fact and in law, based on mere surmises, speculations, opinions, and questionable findings without required quantum of evidence,” it added.
Ombudsman ordered on May 31 preventive suspension of Guo, Ocampo and Sigua citing “strong evidence showing their guilt.”
Complaint was based on findings of task force created by DILG to investigate culpability of local officials in abetting POGO firm Zun Yuan Technology Inc.’s illegal activities in Bamban.
Zun Yuan’s Baofu compound was raided in March for alleged human trafficking and serious illegal detention.
Same compound was raided in 2023 when POGO hub was still called Hongsheng. It was renamed Zun Yuan after the raid.
Based on the task force’s investigation, Guo’s divestment of her shares in Baofu through deed of assignment “is simulated” as P2.5 million involved did not appear to be commensurate to amount of her investment in the company, approximately eight hectares of land.
DILG also stressed in its complaint that despite raid and issuance of a cease and desist against Zun Yuan, Guo “did not cancel or revoke their business permits because of her business interest in Baofu.”
Ombudsman also noted Guo’s failure to ensure that Ocampo and Sigua would “faithfully discharge” their duties and functions to make Zun Yuan comply with cease and desist order.
However, Guo argued that allegations are “conclusory, mere product of conjectures and speculations, erroneous and are contrary to established facts, laws and jurisprudence.”
“At onset, it must be emphasized that respondent Guo acted within scope of her duty by no less than 1987 Constitution, Local Government Code and prevailing jurisprudence,” motion read.
The mayor also denied having business interest in Zun Yuan, asserting that she had “faithfully complied” with guidelines for issuing business permits as stipulated in the Local Government Code and the Constitution.
Lawyer for Guo said it is PAGCOR that has legal duty to monitor activities of POGOs.
“They are barking up wrong tree,” lawyer Stephen David said referring to Guo’s detractors… “why are you asking the mayor regarding POGO activities, why not government people who are tasked to monitor that?”
“She created composite team to do inspection regularly,” he said “why not ask people tasked to monitor POGO 24/7?”
According to David, liability should be with agency appointed by government to do monitoring.
“Interest of government is to get share from winnings as Zuan Yuan was legal POGO…PAGCOR have legal duty to monitor 24/7…now, whether they are doing that or not, it is not within our knowledge…supposedly, if they are not doing that, that’s dereliction of duty,” he stressed.
“It’s good that case is now with Ombudsman at least there, we expect fair trial,” David added.

“We Filipinos are renowned for our hospitality and historically, we have extended this especially to vulnerable individuals in need of safety from war and persecution,” Justice Secretary Jesus Crispin Remulla said in his speech read for him by DOJ Undersecretary Raul Vasquez Philippine government has affirmed its commitment to provide support and aid to refugees and stateless persons as it launched country’s first National Refugee Day that will be celebrated nationwide on June 20.
Move comes after Presidential Proclamation 265 from 2023 declared June 20 every year as National Refugee Day and requires all government bodies, government-owned and -controlled corporations, state universities, local government units, non-government organizations and private sector to join celebration.
First National Refugee Day will highlight country’s “solemn commitment to accord humanitarian efforts and provide protected and conducive environment for refugees, asylum seekers, stateless persons, stateless applications and persons at risk of statelessness,” according to Department of Justice (DOJ).
“Through very first commemoration of National Refugee Day, Philippines sends strong message of our commitment to our long humanitarian legacy of opening our doors and providing support to people who have crossed international borders to seek protection,” Remulla stressed.
Government is also eyeing greater economic inclusion and better legal framework for refugees, stateless persons and other vulnerable groups.
Meanwhile, Chief State Counsel Dennis Arvin Chan, head of DOJ’s Refugees and Stateless Persons Protection Unit, noted that there are about 1,000 recognized refugees in the Philippines and about same number of pending applications.
Chan said these refugees are of diverse nationalities, but mostly from Middle East and African countries, majority of whom are seeking asylum in the Philippines to avoid persecution in their home countries.
As to the refugees who have become Filipino citizens, he noted there are fewer than 10 who have undergone naturalization.
Judge Maria Josefina San Juan-Torres also threw her support behind National Refugee Day, noting that judges are trained to handle naturalization cases more efficiently, crediting 2022 Supreme Court (SC) ruling.
That year, SC approved rule that would simplify, reduce legal and procedural hurdles and facilitate naturalization as Filipino citizens of refugees and stateless persons.
Rule now allows electronic publication of petition filed by refugees and stateless persons.
As signatory to key international conventions, Philippines vows protection to those fleeing violence and persecution.

Habagat to downpour until weekend

Philippine Atmospheric, Geophysical and Astronomical Services Administration (Pagasa) said southwest monsoon will bring rains over parts of the country until weekend.
Monsoon , or habagat, is affecting western section of Luzon and Visayas. It will bring scattered rains over Metro Manila, Central Luzon and Cordilleras.
Cloudy skies with scattered rains will prevail over Calabarzon (Cavite, Laguna, Batangas, Rizal and Quezon), Mimaropa (Mindoro, Marinduque, Romblon and Palawan) and Western Visayas as well as in Basilan, Sulu, Tawi-Tawi and Zamboanga peninsula.
Meanwhile, localized thunderstorms may bring isolated rains over the rest of the country.
Around 30 areas may still experience dangerous heat index levels today, with temperatures ranging between 42 and 45 degrees Celsius.

Grammy-, Olivier- and Tony-awardee is latest Filipino to have her legacy in film, TV and stage cemented, in literal sense, in one of the most visited countries for Filipinos.

FMJ congratulates Modi on election win, hopes for stronger Ph-India ties

“My warmest congratulations to Prime Minister @narendramodi for securing fresh mandate from Indian electorate,” President Ferdinand Marcos Jr. congratulated Indian Prime Minister Narendra Modi on winning historic third term in office and expressed hope Philippines’ partnership with South Asian nation would grow stronger.
“Last decade has shown India as sincere friend to Philippines & I look forward to further strengthening of our bilateral and regional partnership in years ahead,” FMJ stressed.
Philippines and India established formal diplomatic ties in 1949.
In March, Marcos stressed need for stronger collaboration between Manila and New Delhi amid security concerns in shipping routes such as Red Sea, Gulf of Aden, and Indian Ocean. Filipino seafarers comprise quarter of sea-based workers worldwide.
Marcos also expressed appreciation for India’s support in upholding Philippine sovereignty in West Philippine Sea during meeting with Indian Minister of External Affairs Subrahmanyam Jaishankar.
Modi is set to be sworn in for third term after close election forced his Hindu-nationalist Bharatiya Janata Party (BJP) into coalition.
Despite expecting another landslide win, BJP lost its majority and formed 15-member coalition with National Democratic Alliance (NDA).

Rice tariff cut a stab in the back

“NEDA has deprived industry stakeholders of their right to genuine consultation and due process,” Federation of Free Farmers (FFF) national manager Raul Montemayor said cutting rice tariffs to 15 percent is stab in the back of country’s three million rice farmers and grain industry.
National Economic and Development Authority Board, chaired by President Ferdinand Marcos Jr., approved new Comprehensive Tariff Program for 2024-2028, includes reduction of rice tariff for in- and out-quota rates from 35 to 15 percent.
“Normally, proposed tariff changes undergo hearings conducted by Tariff Commission…recommendations are then given to NEDA Board… procedure was not followed before lowering of rice tariff,” he explained.
Montemayor recalled during 2023 Senate hearings on ratification of Regional Comprehensive Economic Partnership trade treaty, the executive branch assured rice farmers rice and other sensitive agricultural commodities would not suffer diminution in tariff protection for duration of agreement.
“That honorable commitment has been rendered worthless by NEDA Board, our experience since trading in rice industry was liberalized under Rice Tariffication Law and tariffs were lowered also on non-ASEAN rice imports, it has not been salutary…our dependence on imports from volatile world market has grown from 10 percent of total domestic consumption to around 25 percent…rice retail prices have risen,” he said.
Claims that 15 percent rice tariff will provide major and lasting relief to consumers are “more shot in the dark than probable result,” Montemayor said.
Agriculture Secretary Francisco Tiu Laurel Jr. met with industry stakeholders as part of Marcos’ directive to reduce retail price of rice in the country.
“President Marcos wants more affordable rice prices to ease financial strain on consumers, particularly poor, as well as relieve price pressures that have kept inflation elevated and interest rates high,” Tiu Laurel said.
Marcos has lowered rice tariffs until 2028 to bring down rice prices to P29 per kilo, Socioeconomic Planning Secretary Arsenio Balisacan said.
Tiu Laurel said Department of Agriculture (DA) has started trial selling of rice at P29 per kilo at select Kadiwa centers.
During consultation, rice industry stakeholders vowed to cooperate in lowering rice prices.
Newly approved tariff rates aim to ensure access and affordability while balancing interests of consumers and local producers, Balisacan said.
This would benefit poor households, including beneficiaries of government’s conditional cash transfer program or Pantawid Pamilyang Pilipino Program, he said.
Cutting rice tariffs from 35 to 15 percent will substantially reduce rice prices in market, Speaker Martin Romualdez said.
“Import levy reduction and direct sale of imported rice by government through its Kadiwa centers should bring down retail price of rice substantially, especially for consumers,” Romualdez said.
Farmers should not worry about government assistance they receive through Rice Competitiveness Enhancement Fund set up under Rice Tariffication Law, he noted.
As of May, fund had accumulated P16 billion from import tariff collections, he added.
“This means government has enough funds to help farmers, while it is trying to bring down rice prices through import tariff cut and direct Kadiwa sales,” he said.
House Deputy Minority Leader Mujiv Hataman also welcomed tariff cuts.
“We welcome the executive order being prepared to reduce tariff rates on rice and other commodities, as this also aims to reduce price of rice in the market… lower prices, the better for everybody,” he said.

FMJ mulls creation of PNP legal department

“We’ll create office, legal office within PNP who will be the defense council of any policeman who is charged with whatever complaint, crime,” President Ferdinand Marcos Jr. told Philippine National Police (PNP) to protect police officers from harassment, he is eyeing creation of legal department within.
Marcos ordered PNP to study proposal during command conference he presided over at Camp Crame in Quezon City.
“They should have lawyer to run to just to give them advice and it will be internal, so they won’t have to pay,” he added. Marcos said there were instances when cases were “weaponized” against police.
Measure would protect PNP from influential groups harassing police force, he said.
Providing police with legal assistance within institution will embolden them to do their work, Marcos said.
“They can be charged with anything…some of them charge police officers are powerful figures…they have lot of capability, a lot of resources, a lot of money…they have lot of access to prominent lawyers…we need to have defense as well…yes, we have to protect our people,” he said.
PNP currently has legal service office, but it is reportedly lacking lawyers who will respond to legal needs of police personnel.
PNP spokesperson Col. Jean Fajardo maintained that Marcos’ command conference with PNP is not loyalty check.
The President has also presided over command conferences with military in past weeks.
These took place after former senator Antonio Trillanes IV had alleged that two police generals were plotting to destabilize government and oust Marcos.
Last month, Marcos called on PNP and Armed Forces of the Philippines to remain professional and true to their sworn duties.
