13th month unpaid, no business permit

“Ganito na lang po, mag-issue po kayo ng warning sa lahat po ng mga employer na there will be dire consequences kapag hindi po naibigay ang 13th-month pay on time this year 2022,” Senator Raffy Tulfo told Department of Labor and Employment (DOLE) assistant secretary Lennard Serrano to warn employers their business permits will not be renewed with Bureau of Internal Revenue (BIR) should they fail to timely give 13th month pay of their workers.
“Failing to do so, hindi po ma-renew ang kanyang permit, how’s that?” Serrano said they are constrained to merely giving out labor advisories for employers to follow, but Tulfo was not convinced, saying that those are merely ignored by companies, despite law mandating it.
“Yung advisory po ‘yan balewala po ‘yan sa mga employer…habang hindi po sila nasasaktan, balewala sa kanila ‘yan,” Tulfo said. “Firstly, we’ll order them to pay…kung hindi pa rin po magbabayad, hindi po sila bibigyan ng clearance sa kanilang Certificate of General Labor Standards.”
The labor assistant secretary committed to Tulfo’s recommendation.
In August, Tulfo reminded BIR to focus on “big fish” like oil smugglers, and not “small fries” to boost its tax collection revenues.
